Interesting Claim For Mdd Secondary To Pain - Updated
MAJOR DEPRESSIVE DISORDER I AM SORRY THE BOARD WILL NOT LET ME COPY AND PASTE WHAT I WROTE AND i AM NOT GOING TO RE TYPE IT. I WILL TRY LATER. INTERESTING CLAIM OF MDD SECONDARY TO PAIN Until the research studies determine that they can isolate the many potential factors that could be causing the correlation between pain and MDD the VA C&P examiners and the raters should stay out of the business of pretending that they can isolate separate and distinct issues which would allow for the denial of a secondary claim for MDD in any veteran who has had a long ongoing condition that creates chronic pain. The veteran sustained multiple injuries to bot…

ptsd Order Smrs Through Va Or Nat'l Archives? Triggers!
Sitting here making copies of records to hand to DH's Examiner and am in a quandry about this question. A few days ago DH told me again about the surgery they had to do to "give him ears". The fire had burned his off (blast burned from behind, all back of his head, hands trying to cover protected some but heat flashed around his scalp and took off his ears. Now the army reconstructed them, and sewed his scalp back together so he has a 1inch wide scar on the back of his head and his ears look fine from a distance. I knew about the reconstructions. What I DIDN'T know was that they weren't done during his initial recovery. The army wasn't going to do them at all!!! …

Do The Big Law Firms Really Know How To Develop Evidence?
I have been helping a veteran understand his recent denial for service connection of a secondary condition. The veteran obtained the services of a large and popular law firm. The law firm got off to a good start by using their own doctors to write reports for the veteran. After that it went all downhill. When all was said and done the veteran had one favorable report from a C&P examiner and two favorable reports from doctor’s who were working in association with the law firm. There was also one negative report written by a C&P examiner. The negative report said that it was “quite possible” the veteran’s condition was caused by post service employment. …

Clarification On What It Takes To Close A Claim!
Good Evening My HADITeers! Finally got my C-File today after 5 requests and10 months. Inside of it I got another letter from head honcho of Portland stating that this was my C-File and that I couldn't use this material and that I needed new evidence to reopen my claim. They sent my FIRST denial in October 2011 and I quickly sent them my NOD the first of Nov 2011 and requested a DRO hearing. This is the second letter that they have used this terminology. Am I not correct in thinking that my claim remains open till I either get a final BVA/CAVC denial or if I miss a deadline to file something? And doesn't all my evidence stay good until I screwup and my claim gets closed? Th…

Vaoig Says "rsvr's Are Confused"
The VAOIG did a report on the St. Pete RO, and told us what most Vets already know. (Finding 5, Page 11) "VARO staff did not properly address whether 22 (59 percent) of 37 Gulf War veterans were entitled to receive treatment for mental disorders. These errors occurred because VSC staff lacked understanding of VBA policy and overlooked reminder notifications to consider entitlement to mental health treatment. As a result, veterans may be unaware of their possible entitlement to treatment for mental disorders and may not get the care they need. Interviews with VSC management and staff confirmed RVSRs did not always follow VBA policy to consider entitlem…

Dependents And Retro Payments?
I have a question about my 19 year old son and retroactive payments. I thought I say an answer to this question somewhere, but my memories is shot these days, and I can't seem to find the answer again. Here it is and please forgive me if this has been answered in another thread somewhere. If there is any retroactive payments for dependents (my son) from before he turned 18 will that retro go to me or him, since he is now over 18 and not in school? I ask this question because when my son turned 18 Social Security cut him a $7000 check and he blew it within weeks, and, given his childhood, I don't blame him. Long story. I don't care if he gets any retro, lord knows he de…
