Can I File For Backpay For Service Connected Issues?
I have never applied for increased benefits. However readng HADIT it appearsthat I may be entitled to more than I am currently receiving. Below is my current rating as it stands in eBenefits. The Pes Planus is service related. Hearing loss is service related (I was a 13E in artillery). Nothing for vericose vein stripping? I just had the right leg in surgery. I have other items that I had while in service that have just gotten worse over the years. Can I file for those as well? Secondary to bilateral varicose vein status post stripping 0% Service Connected 02/04/2011 Varicose veins, right leg 10% Service Connected 03/31/1998 bilateral varicose veins status post str…

Concurrent Receipt
Does it still apply when you are 100%. I get retired pay and am rated @100%, but they are withholding until they hear from retired pay. Now I read in 38 cfr 3.750 that at 100% you are not required a waiver and concurrent receipt is not applicable. I called the DAV and he basically ignored me and told me to call my retired pay center. So which is it?

Questionable Claims Agent
I just came across this site yesterday and there is alot of great information here. Hopefully someone can assist me with this issue. Three or four years ago a Veteran I met out and about informed me of a Vet Rep who could assist me with increasing my current 40% rating. I paid him $500.00 up front for representation and he would get 10% of any backpay. However he doesnt call, he is not listed as my POA on the ebenefits website, and I can never reach him by phone or email. I'm at a loss of what to do.

Had my c&p exam today i had everything - imo from dr. anaise for the nexus -several buddy statements as lay evidence to vouch for sleep apnea starting in service -sleep apnea diagnosis and all the paper work - all relevant medical literature/studies/bva decisions identical to mine first thing doctor says is: " i will not grant you sleep apnea secondary to ptsd because that means that your ptsd caused your sleep apnea and that is false"- her i said "sleep apnea secondary to ptsd means it causes or aggravates sleep apnea"- me "no it doesnt" - her "why does ebenefits allow me to file a claim for "sleep apnea secondary to ptsd then if that "term" only m…

Army Reserve Injury Va Claim Question
I am applying for VA disability claim due to injuries from the military. My first injury occurred in 2011 Office School (BOLC) . It was documented at the medical treatment facility but I never received LOD memo for it. I have copies of my medical records from there though. My second injury I torn my labrum during weekend drill lifting supplies. I do have a LOD for this injury. 1) The VA just sent me a letter saying that they need a DD 214 THE PROBLEM: I never been activated on federal orders just for officer school, distance schools and annual training. What do I do? 2) What do I do about the medical injury during officer school without a LOD? 3) My …

ptsd Advice Sorry For Long First Post
Dear Fellow Veterans & Friends In 1993-194 I spent 1 year and a few months in the Army I was stationed at Fort Hood in an E-5 job as an E-1 private just trying to make it through. I did not know I had it at the time but it being an E-5 slot made my job much harder. I was bullied by the other people in my office and made to feel inferior to them. After I got to the unit I was the lowest ranking person in the office so they made me do all the menial tasks like clean the floors & pick up trash in the parking lot etc. etc. along with my job duties. I was a 71D a legal specialist so I would get all the reports of guys doing bad things and why they did the bad t…

I currently have an FDC claim that I am awaiting a decision on. Last week on Ebennies I clicked the "decide my claim" for it since I have submitted everything for it. My current FDC claim is for dental secondary to my Anorexia Nervosa..... ptsd Is This True?
In June of 2013 I submitted a claim for depression (changed by the VA to ptsd). Since that time I have been hospitalized 3 times, two times were for knee replacements and the other had to do with ptsd. My claim has finally gone to prep for decision, but I have never had a C&P for the 2nd knee replacement. So I called the DAV and let them know, cause I figured it would just get kicked back to gathering of dust. The DAV told me that sometimes they will not do a C&P exam if it was the samE Docter etc. Is that true?

Back Pay Question
I just received my back pay. My finding was for 2/10/15 and it is now 4/20/15 but I got paid 6 months back pay. Is this correct or did they screw up. Some of my claims are from March last year but most that pushed me to the 100% was from February of this year. Do they pay a minimum of 6 months back pay? Thank you Confused diver
