Tbi Claim Question
I'm currently rated 30% and been rated for 10 years for 10 L Knee, 10 R knee and 10 depression. I recently filed for a TBI for a fall I had in Japan. I hit a tree face first went to the E.R. Friend took me and told doctor I was out cold for 5 seconds. I must have told doctor I have headache cause it's in my record. Fast forward 14 years I file claim and Va Rater added migranes with dizziness to my claim. I do sauffer from migraines now. Is this a good thing? Because my claim is pending decision approval and I never received a C&p on anything related to my TBI Claim. Oh doctor documented concussion. Two years later I was diagnosed manic depressive with anxi…

Current Mallampati Score Indicative Of Sleep Apnea In Service?
I'll try to make this as succinct as possible. I've been out of the military for 10 years and have been diagnosed with sleep apnea (OSA) and use a CPAP daily now. While in service I had the typical monster snoring issues along with stopping breathing in my sleep that many have. However, the only thing in my medical records in regards to sleeping issues is my exit physical where I checked "frequent trouble sleeping" on the form and the person wrote "difficulty sleeping on ship" in regards to that. 1. Recently submitted claim for sleep apnea and was denied 6 months ago. VA says nothing in my medical records to indicate sleep apnea. 2. Saw VA ENT doctor (ear, nose &…

Seizures And Sleep
Greetings, Recently I've been diagnosed with epilepsy. I was not born with epilepsy. I also now have some rem's problems occurring while I sleep or am having seizures.. waiting to get that sorted out. My diagnoses did not come from the VA. They denied it, even after I had a grand mal seizure. My psychologist at the VA is the one who found me an outside neurologist to figure out if I had seizures or not. Now I have to take part in a sleep study to figure out what the hell is going on. I also came home with some of those non-cancerous abnormal cells they have to cut out that they say was not their issue but they did it anyway. I guess my point is should I try for C…

Question For The Hadit Family
Hello all, In Oct. 2003 I filed a substantive appeal for evaluation of residuals, left ankle sprain currently 10 percent disabling, to increase to 20 percent. Also, I filed in that same appeal for evaluation of residuals, fracture of right talus, currently 10 percent disabling, to increase to 20 percent. In April 2006 they increase the evaluations for both ankles to 20 percent each, what was what I claimed. The RO stated " since a 20 percent evaluation has been granted, this decision constitutes a complete grant of benefits sought on appeal". Not knowing about the rating schedules or hadit at that time, I've read the decision and the ROM Test listed under my increase …

Question On Keeping Effective Date
Hi. I put in several claims in July 2013. Last month is September 2014 I was service connected for several claims and denied for many others. My award went from 40% to 70% and I am very grateful. My question is this. How do I keep my effective date of July 2013 for the several claims that were denied? I will be providing IMOs and or IMEs within the next six months in order to hopefully have these denied claims service connected. Thank you very much for any help on this matter as I want to make sure I do things right this time

Dependents And Down Syndrome
I received my rating of 40%, and the VA sent me the Declaration of Status of Dependents form (21-686C). In section III it asks for the name/DOB/SSN of my children and what their status is... The note in the box right above where you put in the info says: "If any child is claimed as "seriously disabled" (item 14h) it must be shown that the child became permanently unable to support him/herself before reaching age 18. Furnish a statement from an attending physician or other medical evidence which shows the nature and extent of the physical or mental impairment." My daughter has down syndrome. I went looking for anything in writing that classifies down syndrome wh…

Fdc Still Claim In "review" 120 Days So Far
Folks: My (first ever) FDC Claim is still in the "Review" phase of the claims process after 120 days...so far? Is that common or normal for the Seattle Regional Office? Like I've posted before...absolutely everything in terms of all SMR evidence and 14 FDQ's is completed to do the FDC? I would have figured that I would at least be on to the next stage by now? I did get a standard "form letter" at the 90 day mark saying, "we apologize for the delay?" But, that's it to date...

L5-S1 Radiculopathy...
I am curioius about something that is bothering me. I do have L5-S1 radiculopathy caused by OA. Yes I am one of those ppl who the VA has cursed to die on some waiting list on seeing a surgeon. So next week I am going to a private surgeon's office and if he says surgery should have been done or I need it then I am going to do my best to force the VA to pay for the surgery. I want my quality of life back but the VA is hampering this. My question is for those who have or had L5-S1 radiculopathy in both legs, feet and toes. I have the normal pain and numbness and the ice cold feet. But what is bothering me is if anyone of you who had these issues also caused the feet and …

ptsd Question On Ptsd Claim, Got C & P Results Back, Curious What Others Think...
1. What does this mean? "responses to the Minnesota Multiphasic Personality Inventory-2 suggested a valid profile overall, with possible efforts to both present in a virtuous/positive manner and to emphasize psychiatric concerns." (Is this saying I'm trying to look better and worse at the same time?) 2. Also, I think I'm in the 30% range, because it states this " Based on this Veteran's noted mental health symptomatology, it is this writer's opinion that he experiences occupational and social impairment with occational decrease in work efficiency and intermittent periods of inability to perform occupational tasks." which is also what x'd off in the beginning. …

Sleep Apnea Claims Experience With Minimal Service Treatment
Hi All, I have a question for those of you rated or fighting for sleep apnea. Admittedly, I'm putting the cart before the horse a bit here because I am not currently diagnosed with sleep apnea. However, I am lined up to see a private pulmonary doctor and finally get a sleep study. I'm fairly certain I have some degree of sleep apnea based on my wife's observations, and my history of waking up with severe headaches, waking while I'm actually suffocating, and the worst part, constant sleepiness I've dealt with for almost fifteen years now. In any case, I'm looking for any experiences, success/ongoing-battle stories with sleep apnea claims and service connection. Unf…
