This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

Establishing Service Connection For Veterans Affairs Disability Compensation
Establishing Service Connection for Veterans Affairs Disability Compensation: There are two types of service-connection Direct and Presumptive There are three requirements to establish Direct service-connection for residuals of injuries and diseases; In-service documentation of an injury or disease. A current condition with a medical diagnosis. "Before November 2000, when the VCAA was enacted, veterans had to obtain a medical diagnosis of a current disability on their own. The VA was not generally obligated to help them in obtaining this medical evidence. Some veterans, who could not afford a private doctor, were placed in a no win situation…

Total & Permanent Disability
I am a 100% service-connected disabled veteran. I am totally and permanently disabled. Under what circumstances could the VA take your 100% service-connected benefits away? My rep said that after I was deemed 100%, my VA record was going to go on a shelf and collect dust. I was also told that the only way I would lose my benefits is if I (veteran) opened a new claim for benefits after my 100% rating. Is this true?

Nexus letter if I have photographic proof?
Hello, new here. Working through getting an increase on my s/c issues and it has been brought to my attention I should have had my left knee s/c this whole time (medically retired 12 years ago). I have photographs of me competing in triathalons while wearing a knee brace on my left knee while on active duty. Platts data with my matching bib number backs up the dates of the photographs. Is this enough for the VA to service connect or should I still get a nexus letter? I’m s/c for pes planus and right knee, so could definitely get a letter for left knee secondary to those issues, but would prefer to just submit what I have. It seems like a smoking gun, but don’t want to ass…

Recent experience with Automobile Grant?
I just electronically submitted the form for the grant yesterday and I was wondering how long it is currently taking to get approval and the form returned to make the purchase. I I am service connected for loss of use of both feet, so I am confident that it will be approved.

how long after seeing the judge
First, let me say I'm not familiar with all the terminology, so forgive me if I'm not properly presenting my question. I saw the appeal judge on Monday, and she pretty much said she would grant my appeal. So, I was wondering how long can I expect before I see something in my account? I worked with a lawyer, if that matters. thanks

SMC S1
I perused this site and found it informative and supportive. I noticed on ebenefits under additional benefits that my husband is entitled to special monthly compensation under 38 U.S.C. 1114 subsection (s) and 38 CFR 3.350(I) from 8/31/2016 to 9/1/2016; rated date 2.4.2023. Based on the information on this site, he has met the criteria regarding housebound (with my understanding for veterans who are unable to overcome their particular disabilities and leave the house in order to earn an income...) Senate Report No. 1745 June 27, 1960 . And according to ebenefits, on account of bladder cancer in remission (Nehmer Granted) rated 100 percent and additional service-connect…

TDIU
I was awarded TDIU with a 40% rating for constant fatigue syndrome (CFS), and 80% overall. The TDIU award increased almost everything that had previously been awarded, but stated the 40% CFS award was deferred, even though it was awarded 2-3 years ago. I just received an email from VES stating I “may” be required to attend an appt regarding that rating, and I’ll hear from them soon. I was over 55 when all the ratings were rewarded, but I read that the TDIU award can require reevaluation no matter what. Some of the videos I’ve seen made by retired “raters” say the VA can’t required another evaluation for an issue previously awarded, that award is protected if you’re ov…

Artillery Outgoing Residual TBI
Have you seen this article? Veterans and Artillery Blasts: The Battle with Invisible Wounds | CCK Law (cck-law.com) Does it apply to you? A little to me but not near as much as to those enclosed in a shipboard heavy gun mount or those who sent thousands of rounds out from heavy guns.

ptsd TBI as secondary?
Hi everyone, Question... I currently have SA secondary to PTSD and depression. I have been knocked out several times on active duty( parachute falls, combat) but have never been dx'ed with TBI. I do suffer from the memory loss and other symptoms that I've read about with TBI but again have never been dx'ed for that. I had several headache treatments during AD... What route would you recommend to get the TBI claim going? I have a PCP appointment next month at the VA and want to present possible TBI issues. In many ways, I sucked it up after I passed out and didn't run to the Military doc.

Claim for cardiovascular disease secondary to hypertension - request for full record?
Recently I submitted a claim for heart disease secondary to a service-connected condition. I was told by the VA that I had to follow it as a supplemental claim since at the time of my first post-retirement claim many years back I had listed chest pain as a condition. I submitted all of the following online 2 weeks ago: A clear nexus letter from my primary physician who wrote that it was likely that my hypertension had played a role in the development of my heart disease. Multiple (but not all) records from my recent cardiologist (followed now by the PCP since moving). These select records show diagnoses, heart test results, and symptoms. Multiple (but …

Loss of use
Hello, it's been a while since I posted and I looked for an answer everywhere and I could not find one. I am 50% disabled for bilateral pest planus. The question is when I received my bilateral AFOs. They knew they made my condition better. The question I have is on loss of use bilateral feet. In 2014 when I was issued the AFOs should I not have gotten loss of use. The way I understand it is if an orthotic is the same or makes it better it's considered loss of use. In that case. If I file can I file for back pay for loss of use. I am not a writer, nor am I a speaker. I hope that you may understand this. Thank you so much for not closing down. By the w…
