Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

Traumatic Brain Injury-Not Service Connected
I just got my decision back from the VA and they determined that my TBI was not related to my time in service....even though I am currently being treated for it at the VA for concussions due to parachute jumps and mortar fire while on deployment. How is that possible? Any advice on what to do now would be extremely appreciative.

TBI -- NO CP Exam So Far?
Folks: I was injured early in my Army Career and was involved with a Tank Main Gun Explosion which is well recorded and documented in my records. I also have been rated for Bilateral hearing loss for the same explosion and am service connected at 10%. Anyway, my claim is in the review stage now and I have not been sent to a TBI CP exam yet? Also, it does not look like I am going to be sent to an exam based upon how the claim is moving. Anyway, is this common for TBI claims not to be sent for an exam? Has anyone out there had a similar experience before? I waited for this to be the last part of my claim because I was under the impression that TBI claims take a long time t…

ptsd Denied Service Connection For Hearing Loss
Finally got my rating letter after doing an FOI. The original was lost in the mail. Berta asked me post the exact statement for my SC hearing loss denial from my rating letter. Her request came from a post I submitted in success stories and I will do so at the bottom of this post. To support my hearing hearing loss contention I submitted my incoming hearing test which had 10s across the spectrum. On my separation hearing test some nine years later there were pretty much 5s with one 10 and a 0. I think what got me was the C&P. The examiner opined that it was as likely as not to have happened in the service, but then checked no, and commented there was no medical eviden…

Entitlement Question
Here's my situation: I was denied for right and left leg radiculopathy also claimed as sciatia in June 2011 initial claim February 2011. After VA re-evaluation October 2015 with an effective date of 31 July 15, I became 100% P& T and rated for: 1. Radiculopathy in the lower radicular group in the left upper side -40% 2. Radiculopathy in the lower radicular group on the right upper side - 30%. Question: I'm I entitled to back pay for the 40% and 30%? Are the 2011 denial claim and 2015 diagnosis the same? I appreciate any feedback.

MEB/PEB Findings, need advice
Hello again everyone. I recently received my records from the National Archives. My case goes all the way back to 1988 when I first filed with VA for back pain and was denied (reason - preexisting condition), and again in 2006 and was denied again (reason - preexisting condition). I was hoping I would have been awarded due to a service aggravated condition. I've attached my MEB and PEB findings from 1988 and was hoping Berta, Asknod, along with any others, could take a look and give an opinion. I had no issues during basic training and AIT. I was injured two weeks prior to the start of active duty, after being in the reserves two years, in a motorcycle accident. I was inj…

IMO
When it comes to VA disability claims doesn't an IMO from a specialist trump a VA doctor opinion in a rating decision?

Comp back pay
So I'm confused on once your claim was rated and approved on how far your back pay went back. If I recall my va rep told me it would start the day your claim was filed. However I was reading on the va website that if you file within one year of seperation that it would start the day after seperation. I seperated nov 30, 2014 and filed Sept 1, 2015.

EED hail mary? opinions
So i had filed in 2012 for sleep disturbances. I said i had trouble sleeping, that i moved around a lot, was tired everyday even after 9 hours in the bed. I was denied and told not SC. I was recently DX'd with OSA and now i am wondering if i can request a EED for that. From what i have researched to get an earlier EED you have to show that the VA had the information to SC at the time it was denied, etc. However since the symptoms i described in 2012 were symptomatic of Apnea, but no C&P was ordered or questions asked is that not a error on their part. Im not a doctor, i am asking for SC for an issue with X,Y, Z symptoms and they should sort it out? I feel this is n…

Wheres my rating??
Hello, I'm new here. I'm in a 6 year wait to receive compensation. Received letter from BVA dated November 4th, granting service connection for left knee disability, manifested by arthritis, and residuals of a bilateral foot injury, manifested by neuropathy as due to cold weather exposure. No further instruction were included as to rating and/or benefit info. Ebenefits was updated 11/26, indicating a combined disability rating of 30%, 10% for knee and each foot. I'm puzzled as to how RO has concluded rating on knee, due to the fact in 2013 I had a total knee replacement. I was expecting knee alone to be 30%, at bare minimum. This 12 page letter from BVA VLJ includes discu…

tdiu Bva Appeal
Hello, I am new to this website so I hope I am posting this correctly. I have a question about an appeal that I filed in 2008. I am service-connected at 50% for MDD. I filed an appeal for an increase in 2008 a few months after I recieved the decision letter. The appeal is for an increase and in the letter the BVA stated that 70% is allowed for the initial rating. I also filed TDIU in 2009 and was denied. The letter stated I was denied because I did not meet the schedular requirements for TDIU. My question is if my rating increase will they consider the TDIU now and is it likely to be granted? Also, I have not heard anything from the VA regional office about th…
