Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

EED hail mary? opinions
So i had filed in 2012 for sleep disturbances. I said i had trouble sleeping, that i moved around a lot, was tired everyday even after 9 hours in the bed. I was denied and told not SC. I was recently DX'd with OSA and now i am wondering if i can request a EED for that. From what i have researched to get an earlier EED you have to show that the VA had the information to SC at the time it was denied, etc. However since the symptoms i described in 2012 were symptomatic of Apnea, but no C&P was ordered or questions asked is that not a error on their part. Im not a doctor, i am asking for SC for an issue with X,Y, Z symptoms and they should sort it out? I feel this is n…

Wheres my rating??
Hello, I'm new here. I'm in a 6 year wait to receive compensation. Received letter from BVA dated November 4th, granting service connection for left knee disability, manifested by arthritis, and residuals of a bilateral foot injury, manifested by neuropathy as due to cold weather exposure. No further instruction were included as to rating and/or benefit info. Ebenefits was updated 11/26, indicating a combined disability rating of 30%, 10% for knee and each foot. I'm puzzled as to how RO has concluded rating on knee, due to the fact in 2013 I had a total knee replacement. I was expecting knee alone to be 30%, at bare minimum. This 12 page letter from BVA VLJ includes discu…

tdiu Bva Appeal
Hello, I am new to this website so I hope I am posting this correctly. I have a question about an appeal that I filed in 2008. I am service-connected at 50% for MDD. I filed an appeal for an increase in 2008 a few months after I recieved the decision letter. The appeal is for an increase and in the letter the BVA stated that 70% is allowed for the initial rating. I also filed TDIU in 2009 and was denied. The letter stated I was denied because I did not meet the schedular requirements for TDIU. My question is if my rating increase will they consider the TDIU now and is it likely to be granted? Also, I have not heard anything from the VA regional office about th…

Re-victimizing all over again.
Let us start with some basics, i'm 70% PTSD and have filed a notice of disagreement. I have other disabilities but i don't care to discuss, nor are they relevant. i go to therapy session at the VA and i tell my therapist how im suicidal, depressed, seeing hallucinations, etc... i got paperwork from the VA that reads that I had stated to my therapist on such and such dates that i was okay, doing well, medications and treatments are doing well, even went to a gambling town. This couldnt be further from the truth. i'm pissed. for one, i didn't say anything like this. 2: i didn't go anywhere, nor is it anyone's business where i happen to go 3: it was used against me to justif…

Where's my rating/benefit letter??
Hello! After over five years, I was granted service connection on left knee and cold weather injury on both feet. On November 4th I received letter notifying me this decision. Unfortunately, letter did not include further instructions, such as when I'll receive rating and or benefit letter. I was sent for a cp exam within the last 6 months. Just curious of an estimated time frame that I'm looking at. Should I expect another long wait before I receive payment and notification from RO? I've read many stories where folks receive payment before their letter. However, I don't foresee this in my case, due to the fact they do not have my information, such as dependents. I apprec…

C File Request
So i had requested my c file in june. I recently request an update via IRIS (3 weeks ago) and this was their response "Your Privacy Act Request submitted on June 1, 2015, is pending and our records show correspondence was sent to you on June 16, 2015, acknowledging the receipt of your request. At this time we are unable to provide a specific time frame for completion of your Privacy Act Request. Please keep in mind that all FOIA requests are completed on a first come, first serve basis. The law requires a response within 20 working days of the date that the request is received by the custodian of the record. Within that time, the custodian of the record is required t…

ptsd Sleep Apnea SC route to take
Ok Folks, so this is the start of my thread for my sleep apnea claim and i will keep it update as things progress. As it currently stands i am in the process of gathering evidence to support a SC claim for sleep apnea. (As a Note i would purchase Chris Attigs book "PUT IT TO SLEEP" regarding sleep apnea claims, it is superb) I had issues with sleeping while i was in the Marine Corps but never had a DX or a in service note in my Med record of sleep issues. This is a major hurdle that will have to be jumped over. A DX in service is a golden ticket for your claim, short of that a note in your records of anything sleep related "difficulty sleeping" "fatigue" "tired during t…

SC from VA Meds
Can a kidney condition that "more than likely" was caused by VA prescribed meds make the condition SC? The meds are for a SC back problem.

LIVER ISSUES
I had a BVA in July and just received my reply. It was not totally bad news... HOWEVER, I had claimed that i had abnormal liver functions since i returned from Iraq. The ALJ noted that because my civilian doctor held that I had a form of chronic liver disease and the VA denied it, he thinks that an exploration of that nexus should take place. SO, my question is in regard to the specific rating scheme i should be looking at to build my case. I have a nexus to active duty because i took Mefloquine for malaria prevention while i was in country and there are SEVERAL studies now that link chronic liver disease, hepatic cirrhosis and even fatty liver to the drug. HOWEVER, when…

hypertension sleep impairment
I currently am diagnosed with sleep apnea, and use a CPAP. I have at least one entry in my STR where I mention trouble sleeping, while being seen for something else. My question is this, should I file a claim, now, today, for sleep impairment, or wait until my current claim for depression finishes? Also, would then, my SA be a direct link to hypertension? Thanks, Semper Fi. Andyman

ptsd Protected Ratings and Increases/reductions
So I have not put much thought into the protected ratings until the last few months, mostly because i hit my 4 year mark for my PTSD 50% rating this fall and will hit the 5 year next September. I have done research into it, google searches and searched the forum. The forum search didnt really pull up much i think due to the change in format and http:// listing for the posts and how the internal search engine finds them. I know that is going to be fixed soon. This is one part question from me and one part info for other vets out there... What made me want to talk about this is the mention ASKNOD had in his blog post today regarding 5 year ratings (https://asknod.wordpres…
