Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

FDC Claim question
I submitted my claim a few months ago. A week ago, I saw someone at the VA for the same condition, and I called the 1800 hotline about it. They said they will notify the RO to get that evidence. The person on the phone said ur claim will still be FDC. Now I am worried. Will I still be on FDC track?

diabetes Vision Loss
Hello, First time reader and very glad to have a fellow Vet tell me about this site. I did a quick search and didn't find anything addressing my concerns, so here it goes. Background: Several years ago I had a retinal detachment in my left eye.. The doctors reattached it and it never really had the same vision as before. Over the 2 years since it has got worse. I went to specialists and received a few more surgeries and now I am blind in my left eye. I have diabetes II at 30% and was given Macular degeneration as Non Svc Connected (NSC) and Diplopia NSC...but this is controllable and due to my Migraines--which is rated at 30%. (I would like to see the previous two as Svc …

WILL MY MEDICATION CUT MY BENEFITS
In a recent post about my upcoming DRO Review Asknod and I talked about whether or not medication and its making you better affects your rating, i.e. if im better with medication will the va reduce me or if i file a claim will i get a lower percentage? The answer it seems (and chime in if there is a case, recent ruling or CFR change we are unaware of) is that...It depends. Jones V. Shinseki (Click to read case) states that... "Thus, to the extent that the Court did not explicitly hold in Otero-Castro that the Board may not deny entitlement to a higher rating on the basis of relief provided by medication when those effects are not specifically contemplated by the rating c…

ptsd TBI Screening
Didnt want to hijack someone elses thread. I have written about this before but here is the backstory and updates, chronologically. I had posted about this before here Incident: IED attack 1) in slow motion sort of, seeing the dust lift off my cammies a few inches and thinking "thats so cool looking" 2) After I dont know how long starting to hear "GO GO GO GO" since i was driving and we didnt want to lolly gag in the area. I had apparently slowed down to an idle (when above was happening). so i was being yelled at and finally clicked in my head what was going on and we went 3) the sound of the firefight as it was a ambush in conjunction with the ied. i dont remember anyth…

De Facto Secondary Conditions
I am in the midst of getting all the evidence for my TBI claim. i wont go into the background of blast, etc. However I believe that my headaches which are already SC are secondary to my TBI. Now in the future once i make and win (one can hope right?) my claim for TBI will they cancel my migraine SC and incorporate it into TBI or will they rerate it secondary to the new primary condition (TBI)? I guess it all depends on how the rater/examiner decides?

ptsd Has Va Put A Behavoral Flag On You
http://registerguard.com/rg/life/lifestyles/33294902-74/ptsd-patient-dennis-parker-battles-for-vha-care.html.csp There are some good points made in this article, maybe enough to help any vet who has been denied care or moved to another VAMC because of this directive, which has expired and was never replaced as far as I know.

Knee Disability - Don't Think They Got It Right
I have been reading the forum for quite some time, but this is my first post. In 1994 I was originally awarded chondromalacia of both the right and left knee under 5257 (instability) at 0% & 0% for 10% total. It took some fighting but treatment was throughout my military records even saying knee give away and locking. Under recent review of that code it is my understanding that 5257 has to be rated 10%, 20% or 30%, but I have yet to figure out how my original award doesn't reflect that. Onto to today, after a 9-month request for increase and secondary’s I received my answer in May. I was denied secondary for my back and both hips even though I have been wa…
