Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

20% Disabled Id Card?
Hello, I have searched and searched for an answer to this question but there just doesn't seem to be one out there so I will ask here. How do I get some kind of ID card proving 20% disability? Everytime I try to use a veterans discount for something they ask for an ID card. I am talking about trivial things of course like discounts at Lowe's for instance.

Rating Based On Medicated Condition?
I have heard from numerous experts like Berta, etc. in posts that the VA is not supposed to rate based on your condition as it when under medication. I.e. I have sever migraines and have to lay down 3-4 times a months (what htye call prostrating) for them. I am given multiple medications and they now help to limit the headaches from 3-5 a week to 2-3 and the sever ones are helped from say a 9 (out of 10) down to a 7. The VA is not supposed to rate based on what it is now under medication but what it is without medication. What i want to know is where is this in their regulations for future reference. i see this in others posts on occassions and if i had …

Cg Does Not Have Medical Record.
Hi there, I'm actually here to ask this question on behalf of my ex husband, who served 4 years in the Coast Guard. He is about to apply for Disability Compensation for his ankle, and hip. He tore a bunch of tendons in his ankle while he was in. I was able to acquire the hospital notes for his visit, but his xray does not exist there anymore as they are only required to keep their records for so many years. My ex was discharged in 2003. Furthermore, my ex somehow has his medical record! I know that he is in no way supposed to have it...the CG should have sent it off to a records center or the VA, right? I'm wondering at this point how he can prove that his condition…

Question Regarding Disability Claim For The Use Of Steroid Medication
Hello, When I separated in 2005 I received a 0% rating for mild seasonal allergic rhinitis, but it was listed as SC. My allergies have worsened and I've been on two medications (pill and nasal spray) for the last 5-8 years. The VA doctor prescribed a steroid spray (Flunisolide and Fluticasone) that I've been using for a few years now in addition to the other medications. I'm also looking at immunotherapy if I can get the VA to approve a commercial care provider. My question is can I submit a claim to have my rating increased from 0% to something higher since I'm using a daily steroid? I had read that if the vet is taking a daily inhaled steroid that the vet quali…

Chronic Back Pain
Hi all I hope this is the right place to post this question . I am new here bear with me . When my husband was discharged he was awarded a few small percentages for his back injuries he received in Afgan . Am I correct in thinking he can also file for chronic back pain ? We have medical documentation from when he first got home up until now that clearly state his chronic back pain . Would we file this on its own or as secondary to the injuries ? Thank u for your time and service .

C-File Request
I sent in my request for my C-File on June 4 via Certified Mail/Return Receipt and it was received Jun 8, 2015. It has been listed as "Gathering Evidence" since it appeared on Ebenefits around June 20, 2015. Today i checked and it is listed with update as "Requested Documents are Past Due" Im assuming this is talking about the VA and not me, since there is nothing else for me to send to them other than the request and their letter they sent "indicating" their receipt of the request indicated that they needed nothing from me. Screenshot below *Edit* I sent the request to the Records Center in St Louis. after i did that i read on hadit that all C-F…

Lod Approved Now Removed Want A Formal Lod Done
I am currently in the reserves. I had a shoulder injury while I was training and told my commander when it happened. The commander said okay if your pain does not go away then go to the doctors. Less than 48hrs I go to doctor because my pain never went away. I had the 2163 filled out and completed. My commander signed off on my LOD as informal because she was there when I got hurt. I did physical therapy but did not work and surgery was needed. This is a year later from the original LOD. I filed INCAP because I will be out of work for period of time. My INCAP gets denied "put on hold" because regional command says that the initial LOD was not done properly. That they…

ptsd C&p Exam And Suicide Talk
Starting a new thread for a conversation out of a different thread. Below is the succession of these posts/replies It sounds like even if they found you unfit that your finances are in order. The biggest thing is if they decide to say you arent and then based on your financial history you miss a lot of payments, have collections then its a pain. if you are good to go then its hard to make that decision. Im glad you sought help, thats the most important thing. As far as a nexus event it does not matter regarding combat, however if there is no "trauma" that happened in service that started this its hard to make a case for a comp claim, i sho…

Shouldnt I Be 70%?
I have uploaded the decision for my predetermination for Reduction, which was dropped however I found it strange that they wrote that.... Evaluation of post traumatic stress disorder (claimed as mental issues and sleep disturbance) currently evaluated as 50 percent disabling. The proposal to reduce the evaluation assigned for your service connected post traumatic stress disorder (claimed as mental issues and sleep disturbance), which is currently 50 percent disabling, is rescinded. This condition will continue to be evaluated as 50 percent disabling. We have assigned a 50 percent evaluation for your post traumatic stress disorder (claimed as mental issues and sleep d…

ptsd Claim Questions
I submitted a new claim for some other issues i had been holding off on claiming so as not to put too much on my plate at once. 1) Fatigue: I am always tired. if i sleep for 10 hours or 5 it feels like 1. I was tested for Sleep Apnea and it was a no, i do have apnea/hypoapnea events HOWEVER not enough to warrant a CPAP or to qualify for "Mild" sleep apnea according to va regs. All that does is mean it is something else. I fall under the quals for Gulf War Vet era service for timeframe and AO where i was. 2) Foot Pain Cramping: I claimed as flatfoot which they are but my doctor indicated i had plantar fascitis as well. I sent in the exam notes, etc. Second…
