Denied Tdui And/or 100 % And I Am Almost Crippled!
I got hurt while serving during the Gulf War. They performed reconstructive surgery on both of my Feet(screwed them Together) This has caused me allot of pain and an abnormal gait for all these years. Now I have misalignement and degenerative arthritis in both hips which also catch and pop out every so often. I also have Degenerative Disc Disease, Degenerative Arthritis, 5 bulging discs, a pinch sciatic nerve, and facet syndrome in my lower back. I never went to the VA for treatment for over 19 years other than in 1997 when one of my feet broke and they had to redo it. Okay. So today I got the actual letter from the VA about my TDIU award. My combined rating is still 80%, but they'll be paying me at 100% with no examinations scheduled in the future. They also state that basic eligibility to Dependents' Educational Assistance has been established from my claim date back in 2009. (Could this mean they might retro and pay for my kid's last year of college?!) Chances Of Approval?
I was awarded a combined rating of 70% in 2008. I sent in a claim for IU permanent and total in Jan. 2011. My claim is still sitting in the gathering of evidence phase, I know have patience. What I am wondering is that I am rated at 50% for migraines which is the maximum and part of the criteria of that rating is that it causes sever economic impact on your ability to work, I am also rated at 30% for bipolar disorder and my VA Psychiatrist who I have been seeing for over 5 years has written a letter which I sent to St. Pete RO which stated that he considers be permanently and totally disabled but when I went for my C & P the "girl" who examined me for psych said I …

Hey folks, i appreciate any help upfront. Here's the cliff notes version of my situation: I received an approval on an appeal for ptsd in 03/11 time frame with a 70% sc for ptsd. In the letter, the va stated that because i have had so many jobs and other problems since i have been out that unemployability was inferred and my file was being reviewed by the appropriate board. A week into april i receive a letter from the iu board with the required paperwork, instructions, etc. I filled it out and turned it in on around 4/30/11. Greetings, I hope that someone can offer me some type of advice. I have a service-connected disability rating of 10% (PTSD)(2007), which is grossly underated. Against advice from a local vet rep because she said I would surely be denied, I applied for Ch. 31, Voc Rehab. in 2009, I was found to be entitled to Voc Rehab, the counselor that assessed me, was very distraught at the fact that I was rated 10%. Received my envelope recently and needed time to think about claims. As I reported earlier I have a 50% rating for PTSD and since I do receive disability from social security I put in for TDIU.I don't think SS gave disability on PTSD alone, I just wanted to mention that. I also had a claim in for tinnitis which was granted so now I am at 60%. Calling All Hands on Deck, Anyone know what the VA Form # is to request the 100% scheduler rating be given & the IU to be moot? As I understand when a veteran is rated for combined IU/with P&T and no future exams schedule and his S.C. Disability is of nature not expected to improve in his life time. When Is Retro Pay Start Day?
Wondering about when back pay retro would start. From your new open claim date? Or can it be established when you stop working and are considered unemployable from your previous employer and doc's? Since it took me one year of no employment and know idea that TDUI even existed. And I was in and out of hospitals with little to no way of even starting a new claim if I even knew. Basically I haven't worked since 01/13. Started my new claim for TDUI 02/14. Nobody seems to no the answer to this lol:)
