NOD Help for Secondary Conditions.
Greetings to all members to Hadit. The question may have been answered in the forum but I can't find and answer anywhere so therefor any help would be greatly appreciated. I have recently file a secondary claim for bilateral knee conditions caused by my bilateral flat feet which I am rated at 50% for. I do have a diagnosis for both knees which were submitted. The examiner opined that I do have a bilateral knee condition that is less than likely than not caused by bilateral pes planus. The examiners rational was " that the veterans bilateral condition was due to a specific incident or injury while in service and not by pes plans". To me, the e…

BAV appeal
So I may answer my own question here and I think I am correct. When a remand is sent from the RO back to the BVA is that the RO suggesting what to do? I thought once they put that on their then it was implemented, but it makes sense this would be for the judge to look at. If so then I understand why I am not at 100% yet. The judge approved the % today and also sent the date back to 2013 which would be correct.

38 usc 3.102 Am I reading this correctly?
Is the stuff below reality or wishfull thinking? §3.102 Reasonable doubt. It is the defined and consistently applied policy of the Department of Veterans Affairs to administer the law under a broad interpretation, consistent, however, with the facts shown in every case. When, after careful consideration of all procurable and assembled data, a reasonable doubt arises regarding service origin, the degree of disability, or any other point, such doubt will be resolved in favor of the claimant. By reasonable doubt is meant one which exists because of an approximate balance of positive and negative evidence which does not satisfactorily prove or disprove the c…

Ms Sharon Duncan
I was in the Army for seven years. Been out since 85. I presently have a 90% disability due to a knee replacement, back stabilization, organ loss, and sciatic partial paralysis. Recently I have developed Vertigo. Out of nowhere for no obvious or apparent reason. (no water, no concussion, no infection) The Doc prescribed prednisone to reduce internal pressure/swelling in my right ear. I've been receiving the Eply maneuver via physical therapy which helps but does not stop the dizziness. The Doc says give it time it should go away. It definitely interferes with quality of life. Is it compensable? I am a long timeout of service. I've claimed hearing loss but was denied lo…

Appeal Remanded...
My Legacy Appeal was Certified Jul 2019. In the time that my case was at the Board, I had filed new claim for Hearing Loss and Tinnitus; 0% for hearing and 10% for Tinnitus. Beginning in late August, I sought out a local lung specialist for a complete exam and evaluation of the collapsed lungs. He had determined that the left side chest tube caused an injury to the Intercostal Nerves. This is accidental and also common. All of that evidence, including a CAT scan went straight to the Board. When the evidence was faxed, I had waived any consideration of the RO for the new evidence. I wanted the Judge to see the new evidence and decide my Appeal. The Board punted…

What's the best way to appeal a grant?
So my original legacy claim was denied and I did a nod for a dro review. The dro granted 1 condition at 0% and denied the other two. If i just want to appeal the rating on the one granted at 0% which would be the best route to take. I dont need to add additional evidence as i feel what is in there should be good but I can if you think it will be better. According to va.gov both a supplemental and higher level review both take 4-5 months. I was originally legacy so would this now become ramp? Not sure what to do next. Thanks

NOD, CUE or just refile?
It's a mess and a long story, but I don't know what my best course of action is. I have a rare genetic condition, Ehlors-Danlose syndrome(EDS). It got discovered a few years after I got out of the military. I was already service connected for a shoulder issue which actually was a manifestation of my EDS. I claimed EDS the first time in 2013. I framed it that my shoulder condition is actually my EDS. A few years later I got a statement of the case; denied, "the service connected shoulder condition is a separate issue from the EDS" So, I went and got IME that clearly links my EDS to my time in service. December 2017 I filled a new claim the EDS along w…
