BVA Pending with Judge
I am hoping someone can explain to me what is happening with my BVA case. I filed a BVA for two issues, SA and hypertension via RAMP. They have been with a judge now for two months. The odd this is there is a second BVA claim originally for four items and recently went to nine items. Is what makes this so odd is that I have only filed one BVA claim. Now I did a RAMP for a higher level review for four items for a EED, but that has already been decided. Does anyone have an idea of what may be going on? I have called the BVA number and spoke with someone about the two appeals but they could not answer why. Thanks.

Appeal Or Request For Increase Avn Hips
Hello, I have been diagnosed with avascular necrosis of my right and left Hip. I completed a claim indicating that the avascular necrosis of my hips was secondary due to chondromalacia of my right and left knee with instability (40%). Went to the C&P exam, was examined and had x-rays taken. I recently received my award letter and won an award for chronic ligamentous capsulitis bursitis, avascualr necrosis of my left femoral head (10%). However, I feel I have been misdiagnosed by the C&P medical examiner due to the fact that I did not receive an award for avascular necrosis of my right hip. Reconsideration of Decision
I filed a claim for sleep apnea and PTSD. Originally with my claim, I only had buddy statements for both conditions with the addition of a diagnosis from a doctor for my Sleep Apnea. My claim went to a decision of denied Sleep Apnea due to no complaints in service and PTSD being denied due to lack of diagnosis in my medical records. During the claim period, I was able to obtain a letter from my Psychologist diagnosing me with PTSD and 2 additional eye witness buddy statements. My VSO said we will file a reconsideration instead of an appeal. Has anyone done a reconsideration? All the research I have done states that the VA will reset my effective date, and to not do a reco…

To RAMP or legacy appeal?
recently one of my claims was denied and attorney is appealing it. the VA C&P agreed with the claim and attorney mentioned the denial was bogus/bs. pretty sure that was at the DRO level. attorney asked me if i want to RAMP this appeal or legacy appeal. we already waited almost 3yrs when this denial came in and likely another ~3 years when it is legacy appealed, not on the RAMP system. my understanding is we don't lose appeal power going with RAMP, is that correct? attorney isn't getting worse results with RAMP than say the legacy appeal way i'm told. before i green light RAMP i want to ask, are veterans choosing the RAMP path now & finding it worth it s…

Back pay
Hello I filed a nod back in 2012,and in 2018 my case was remanded back to the regional office.I recently opted into the rapid appeals program and I got my 100% disability but they put and effective date of March 2019 instead of 2012 what can I do because it's not showing my back pay.

BVA Appeal with VLJ
My appeal was received by BVA on 11/20/2015. Latest progress shows VLJ since 01/14/2016. Any idea on timeframe for a decision. There are six appeals combined with ten contentions going back to 2009. Is decision likely in weeks, months or years? Please weigh in..

Effective date and retroactive pay
Hi! My husband was increased from 30% to 50%. Under "What We Decided" they changed one of the claims that was initially denied to 0% with an effective date of 10/2010. Then they increased another claim from 0% to 20% with an effective date of 2/1/2017 (claim was initially filed in 2010 for this and he got 0%..now they agree that his issue worsened). We are are trying to figure out if he would be eligible for backpay at all? Thanks for any info....

New medical opinion
My appeal was remanded for the following "Obtain a new medical opinion regarding the etiology of Veteran's spine disorders. Whether to conduct a new examination is left to the discretion of the examiner". It goes on to list four specific issues they want addressed. Basically i pointed out errors on the C&P exam the R.O. used to deny my claim. The board ruled the exam inadequate. The exam was performed in 2015 by a physicians assistant who still works at VA. Can the RO get a "new" opinion from this same P.A. or does new mean the opinion must come from a different examiner? Also if the examiner decides to issue an opinion without a new C&P exam how ca…
