Survivors- a Must read
If you are new to hadit and have DIC questions it would help us tremendously if you can answer the following questions right away in your first post. What was the Primary Cause of Death (# 1) as listed on your spouse’s death certificate? What,if anything, was listed as a contributing cause under # 2? Was an autopsy done and if so do you have a complete copy of it? It can be obtained through the Medical Examiner’s office in your locale. What was the deceased veteran service connected for in his/her lifetime? Did they have a claim pending at death and if so what for? ptsd Grrr - I Got Another Rubber Stamp Denial
AMC came through with a SSOC in todays mail. Once again, I am denied for DIC. They did not list my evidence. (spoilation?) Rubber stamp again! They did not address my issue - that PTSD contributed to my hubbys death. (denial made while not condiserating my position) As an aside, they mentioned the DVD I sent them with the second set of papers but did not list the evidence, and never mentioned the original documents I sent...(spoilation?) I have thirty days to respond, which I will, with the full gamut of information I have already supplied. They said if I do not respond within 30 days, they will send the file back to the BVA. Champva And Survivors
What happens when the ChampVA sponsor dies and before the surviving spouse has their DIC approved? Does ChampVA stop until the survivor gets their DIC claim approved? If my wife were to be on Medicare as primary and ChampVA as the secondary medigap coverage and I croak then what? I know the money from my compensation stops, but do all the other benefits to the spouse stop as well until she/he has DIC approved? My wife is entitled to three survivor pensions so to speak. She would be eligible for my SSA, my Civil Service survivor pension and to DIC. The thing is how long does it take for all this to kick in after she applies? Not many survivors just snap out of it…

The Term "as Likely As Not"
does the va have to add to the term "as likely as not" ... wording such as "it is more...", "less likely than not" ... or other wording or do they say simply "as likely as not" when deciding a service connection claim? i have so many different explanations. i am asking here for anyone's opinion. thank you

Wow, I Got My Dic
I filed my DIC claim in Dec. 2009 and I called VA today and I was told my DIC was granted yesterday. I have never been so surprised in all my days. I was told it would be possibly a year or longer as the VA is swamped. Who knew. Just thought I would let all know. teejay

If a person was granted 100% TDIU retroactive back 10 years, would a surviving spouse have immediate entitlement to DIC, if the veteran dies of a non service connected disability. Happy Trails Paul

Lung Cancer Rating
My husband was recently diagnosed with lung cancer, and is an AO Vietnam Vet. The diagnosis occurred during a surgical biopsy and a lobe of his lung was removed at that time. Fortunately, it was caught early enough that he did not need any other treatment. While he was hospitalized after the surgery we became aware that lung cancer is on the presumptive list for Agent Orange. He filed with the VA as soon as he was able, about a month later. My question is this: Does the rating system for lung cancer work the same as for prostate cancer - will the fact that he filed after the surgical treatment of his lung cancer mean that he was then considered in remission (…

Lost A Good Friend On His 64Th B'day
Need a little help. A good friend died, on Friday, 5/6/11. He served w/101st Airborne(but he was a leg/non-airborne) 3/187 "Rakkasans," and was at Hamburger Hill. I'm fairly sure he was over 10yrs at 100%. Two days after he died the VA awarded him 10% for IHD, back to 5/2010, but no change in comp payment. We have the service and burial of his ashes, tomorrow. Cause of death was pneumonia, secondary to COPD. No autopsy done. COPD wasn't SC but has over 10yrs at 100%. Unfortunately no will or trust - people please do these things now!!! I have my husbands death certificate and I'm wondering if I write the cause of death here can you tell me if I will qualify for DIC benefit. My husband was 100% Disabled due to service connection Cancer of the Larynx (twice). His death certificate reads: Immediate Cause of Death: "PROBABLY METASTATIC ADENOCARCINOMA OF PANCREAS TO LUMBAR SPINE" Other Significatan Conditions contibuting to death but not resulting in the underlying cause given: "HYPTHYDROISISM, HISTORY OF LARYNGEAL CANCER" I will be filling out forms this weekend. Benefit's For Spouse After Death
This has most likely been covered, however can someone please explain / confirm so that I understand. I am 20 year retired Navy in 1991. I am VA 60%. Have been married for almost 18 years. If upon my death, if it has anything to do with my service conected disabilities will my wife be entitled to received anything? Example... I am service connnected for High Blood Pressure, so if my death has anything to do with that, is my wife entitled to anything. IF so will it be automatic or will she have to apply. Thanks Joe

Tricare Supplemental Insurance
hi all; i have been looking for an insurance to supplement my tricare standard. so far, i found out i am not eligible for moaa, usaa or mba. does anyone have any other thoughts for a good supplemental insurance? i like tricare prime, but the doctor i have been seeing for over 2 years is not on the primary care list and i do not wish to change to a doctor on the list. so i am going to wait before i change to tricare prime. i found asi (issued by hartford insurance), but it is expensive and has a big deductible, so i am going to look a little longer. thank you for your help. have a great day. teejay
