  1. No, he's not a whiner, nor a phoney. He's a veteran, who happens to be retired. Are only veterans who get their limbs blown off in wars be entitled to any benefit at all? If so, how could anyone that's discharged from the military without a disablity on their final day ever warrant any disability? I guess that's where you and Chairman Buyer want the VA to go anyway. But one of the issues that we vets are fighting for is those kids coming out of Iraq (and previously Vietnam, Korea, etc.) to get their disability retirement along with their veteran's disability compensation.
  2. the fact that dfas has paid me my retirement in full is what puts the va on the hook for paying the crdp. yes, crdp is taxable when paid by dfas, but not when paid by the va. i think people view crdp as a dfas-only payment. it's not. it's just that dfas actually calls it crdp because they thought it would be easier for them to waive the entire va payment, then add crdp back in separately later. imagine, if you will, that one of us has chosen NOT to waive his/her military retirement. thus, their va was being waived in lieu of their retirement. once crdp came out, the va would have to pay it. i'm sure there isn't a single case of this out there, but if you stop and think about it, you'll see that crdp is not the exclusive burden of dfas. so, when we retirees have been granted 50% or more disability by the va after january 2004, and they withhold our va payment saying that it's been paid by dfas, they are FORGETTING that crdp is not subject to that withholding. therefore, all the crdp IS owed by the va. (remembering that crdp started in january 2004 and was not paid nor retroactive prior to that.) what we need is a list of people affected by this. let's take it to them as a group.

  4. I cannot accept "you're hosed" as an answer to this question. (no offense) It's called CONCURRENT RETIRED DISABILITY PAY. concurrent is the key word. both agencies are supposed to pay the OVERLAPPING amount. the VA claims that we've received our pay, however, if our disabilities would have been granted earlier, we would have received the CRDP. it's a smoke screen to avoid payment. and we have to not accept that as the end of the line. it's taken us 100 years to get some concurrent receipt, now is not the time to give up because our newest retirees who are just joining the disabled rolls.
  5. I retired from the Navy in 2004. I originally applied for VA disability and was granted 60% for sleep apnea, arthritis, tinnitus and cubial tunnel. I was denied hypertension, which I appealed and won a couple months later for a 70% rating. Annoyed by the fact that CRDP would not be paid retroactively by the VA (since DFAS has paid their share), I appealed the decision for back pay of CRDP. At the same time, I also filed claims for depression, acne and neurolegia in my thigh. Today, I received notice that my appeal was granted with a 90% overall rating. I am still waiting for a BVA decision for the back pay. While I'm satisfied with my rating, I am very dissatisfied with the failure of the VA to recognize that CRDP applies to the VA as well as DFAS. I sought help from TREA, but they simply could not grasp the concept that concurrent receipt applied to both agencies. So, I contacted the DAV. They simply never returned my calls. So, I contacted my congressman and senators. I've gotten some letters, but nothing has been done. If anyone has any advice for me, I would appreciate it.
