  1. I have a question and need some advice. I put in a claim for OSA in 2014 and per the award letter received in April 2015 I was denied. After the denial for OSA, I initiated a NOD to keep the claim open. On 18 August 2016, I looked in ebenefits and noticed they had given me a non-service connected (NSC) (pension) rating of 50% for OSA as a secondary to my service connected (SC) Sarcoidosis and Asthma. This rating didn’t appear until 18 August. Check ebenefits weekly. I called the regional office (RO) in Montgomery Alabama on the next day and I was informed that I had received the award in April 2015. The RO then explained that the VA says in their notes that they agree that I have OSA, but not due to my SC disability of Sarcoidosis and Asthma. I am SC for 3 disabilities, Sarcoidosis with Asthma, PTSD, and GERD. I have conducted research in the Board of Veteran Appeals (BVA) and found appeals g showing that other veterans had been granted SC for OSA for each of the disabilities that I have. In my opinion VA has acknowledged that I have OSA by giving it a rating of 50%. My goal now is to have it changed from NSC to SC. Is there anyone with experience in do so? If so, please lend me some advice.

  4. Just want to thank everyone here for the help. I have not posted anything here but has always been a lurker, checking to see what everyone else has done to get their disability ratings increased. I was recently awarded 60% for asthma which I developed 4 years after leaving the military and wouldn't have been able to get it if I hadn't learned the ropes from others here. Was also awarded 50% for PTSD giving me a combined rating of 80%. This is a great site and I'm happy to see that theres so many people here willing to help others. I work with Soldiers on a daily basis, and when they mention that they are retiring or so, this site is the first thing I give them and then I tell them to do their homework. Again thanks!
  5. Doesn't this throw off the timeline for DFAS to impliments the rule of all persons recieving retirement pay and are disabled would recieve 100% of their retirement pay and full disability pay by 2014?
  6. Got a call from a member of the rating board at the Montgomery AL RO. I was surprised because the person called to inform me that members of the rating board were trying to deny my claim for asthma, even though I had not been given a C&P. The lady asked me to take down her name and number and to make a note of the date, then told me that if my claim was denied, I needed to file a complaint because the RO failed to schedule a C&P. Needless to say, a couple of days later, I recieved a letter in the mail scheduling a C&P. After all was said and done, I was awarded compensation for asthma even though I was diagnosed with asthma 3 years after leaving the military.

  8. I have severe GERD and was rated 10%. If I'm not mistaken it can go as high as a 30% rating. As long as you have everything documented, there shouldn't be a problem.
  9. I made the mistake and requested my c-file in the middle of a rating and it did start the process over. I'm currently in line waiting for my file to go back in for rating. My claim has been in since May 2008.

  11. Thanks Phillip. Is there are particular form needed to request a rating on the current disabilities or do I just put it in a standard memo?

  13. Gulf War Vet. Do not have any combat awards. Is there any way to get the VA to rate the other disabilities or will this be a way for the VA to drag out my claim and close it later screwing me over?
  14. I filed a claim in May 2008 for increase for Sarcoidosis, GERD, Asthma and PTSD. For about the last 2 months I have been told when contacting VA through IRIS or by the 1-800 number that they are waiting for guidance from JSRRC in reference to the PTSD. My issue is that the VA have all documentaion needed to rate the other 3 disabilities but is holding up everything because of the PTSD. Is there anyone else waiting for information from JSRRC, and if so, how long have you been waiting? It has been very frustrating trying to get this claim through the system.
