  1. progression is documented dating back to 1980. the dbq's in question are secondary claims to 1.PTSD, Ed. 2.Secondary right ankle fracture, , DBQ -Left ankle, knee pain arthritis, , DBQ -hip & thigh conditions Degenerative arthritis. The C&P doc did not attempt any investigative conversation. Doc only asked my name & last 4. As well, The doc didn't appear to notice my knee brace on the left knee or the cane I use. The above claims were denied obviously due to doc's statements, and the RO did make a statement of my submitted evidence from my active duty medical record proving back and leg injuries documented continuously in my med record over my career. And the claim is still in administrative review. Which, they may be moving fast as a rock. Thanks wes
  2. Reading back over my previous posts. Va accepted the recon and didn't piss the time away. Went to the VA media office and had my records printed and as I read over the DBQ's. The Doctor performing the exam on my ankles, legs, and back and neck, E.D. This Quack didn't ask me anything other than Name, and ssn. And did nothing more than throw me Under the bus. They didn't even address the secondary E.D. claim to the already awarded PTSD. Well needless to say , the regional office denied what I had filed based on this Quacks DBQ. PTSD INCREASED TO 50% 10% FOR TINNITUS VA agreed that all these filed claims were in my active duty record (which I personally copied before retirement) There is no evidence it has progressed, although all these claims are as well documented in my VA file. So this is why I feel the above Quack Threw me under the Bus. How do I file a formal complaint and will it do any good? Thanks
  3. Can the priority group status for a vet be changed as their disability changes ie: increase in disability and/or ssdi award? and how would one start in requesting the change? Thanks wes
  4. Any Veteran in a claim status should, search these documents. "citation granted for service connected __________". fill in the blank with condition claimed. These are the BVA court documents which either granted or denied that persons claim for disability, and the conclusion of law under va regs which guides the decision. This absolutely helped me in understanding the proverbial decision mill.

VA re-opened my claim thru reconsideration, and just completed C&P exam for left ankle, knee. bilateral hip pain due to right ankle fracture right knee. degenerative disc disease, hearing loss & bilateral tinnitus, TDIU. Processing 21-2680 Aid and Attendance. Almost holding my breath to see where it goes. As well I studied tons of va claims online ie. "Citation Granted for Service Connected ___________". Fill in the blank with condition claimed. these are the Offical documents of other Veterans claims and appeals. The conclusion of law in these cases really help in understanding the Quagmire. Although at times these are excellent sleeping aids... THANK YOU ALL
  6. Thank you Now I think an feel I might have a battle plan, although I am gonna hold my breath just a little bit. SSA sent the SSA docs med eval to the VA here, and it is what the VA denied me for Primary and secondary claims. I filed the first claim as to right ankle fracture, arthritis, and gout. un- knowingly I filed the (left leg, ankle, knee and hips, not as secondary), My mistake. So now I have learned how to ride a bicycle once again. Again THANK YOU GUYS FOR THE WISDOM!!!
  7. Thanks Berta I do not as such have a va rep other than the American Legion who represented me by proxy in the claim. I did not choose them, so I guess they were there when my file came up for review. I was not notified of the trial date or anything else. I have obtained some good tips from the DAV here as far as research into VA cases on line, which has been excellent ideas. Now I have just been awarded total disability from ssa with in 6 months, and the disability elements awarded are items the VA Denied.. If I were to file again with the SSA doc's med eval, Would that mean anything. And I realize it might Have something to do with the Moon phase, as well as how lucky the rater got last night. And I have three secondary claims waiting to send in. Thanks for your Ideas and help to everyone ,
  8. That will be accomplished today(0960p DBQ). Would a Reconsideration (be as such quicker) than a NOD? Considering the depth of the processing mill at the VA.
  9. Thanks. I have a question. Just awarded 30% for my PTSD, But with the combined rating with the first 20%, I have 40%. I am going to appeal and I,m leaning towards reconsideration rather than NOD, which I understand an NOD will basically start the process over. I have 11 months to file a NOD. As well I have two other separate claims filed for secondary to PTSD, which one is currently in review. Got any advice?
  10. Retired U.S.Navy, Combat aircrew. Retired in 1996 and thought I'd work to at least 65, but that changed back in 2008 when Duty & Adventure caught up with me. Now the rain pain, author and PTSD took over. Trying to file own my own accord and finding every quagmire in the system. So I here, learning from all you salts. I have plenty of questions that will be posted shortly.
