  1. This is how it reads on ebenefits, it seems like that added them to come up with the 60%. Entitled to special monthly compensation under 38 U.S.C. 1114, subsection (s) and 38 CFR 3.350(i) on account of asthma rated 100 percent and additional service-connected disabilities of onychomycosis and tinea pedis, claimed as foot fungus, acne vulgaris with acne keloidalis nuchae and pseudofolliculitis barbae, patellar tendonitis, left knee, tinnitus, patellar tendonitis, right knee, right 5th finger injury , independently ratable at 60 percent or more from 10/08/2008. You are receiving the following compensation SMC (S-1) Effective Date : 10/08/2008 Rating Date : 06/11/2015
  2. I emailed him on 6/1/2015. Below is the email that I sent him. I got some of the text from this board and kinda added my own. I am rated at 100% P&T. I have the following ratings: 100% -Asthma (Effective Date: 10/08/2008) 30% - Skin disorder (Effective Date: 05/11/2007) 10% - rt knee (Effective Date: 07/14/1992) 10 % - left knee (Effective Date: 07/14/1992) 10 % -right 5th finger injury (Effective Date: 07/14/1992) 10% - onychomycosis and tinea pedis (Effective Date: 03/06/2007) 10% -tinnitus (Effective Date: 05/11/2007) 2. Overview of Requirements for Housebound Status Under 38 CFR 3.351, Continued b. Determining a Veteran’s Housebound Status Veterans eligible for disability pension qualify for nonservice-connected (NSC) Housebound status if they have a single permanent disability rated 100 percent under a schedular evaluation, and have other disabilities independently ratable at 60 percent or more, or are permanently housebound by reason of their disabilities, per 38 CFR 3.351(d), or qualify under Hartness v. Nicholson (2006) when pension was granted based on the veteran's being age 65 or older. Notes: In NSC claims, the single 100-percent disability and the disability that causes the veteran to be housebound must be permanent. A finding of Housebound in this manner is sometimes referred to as “statutory housebound” because it is required by 38 U.S.C. 1521(e). In reference to VA letter dated June 2, 2008, service connection was granted with a percent assigned of 100% for "Asthma", I AGREE with the rating, and REQUEST the required CONSIDERATION of an INFERRED ISSUE. I refer to the issue of SMC-S, Statutory. Based on the evidence I believe I meet the criteria for SMC-S and request that since that I be awarded SMC-S retroactive to my original 100% award date of June 2, 2008.

    Smc (S) Help

    I contacted a VA attorney to see if I qualified for smc (s). He replied with the following: As for SMC(s), you will need a 100% rating and a separate 60% rating (for a single condition different from the 100% rating). Unfortunately, we can't add other ratings to get the combined 60 for SMC(s). Here is my story. I've been 100% P&T since 2008. My ratings are below 100% -Asthma 30% - Skin disorder 10% - rt knee 10 % - left knee 10 % -right 5th finger injury 10% - onychomycosis and tinea pedis 10% -tinnitus I believe I qualify for smc (s) from what I've read and researched. Please advise if I'm wrong. My asthma is rated permanent in nature per va. I received the 30% skin disorder rating in 2008. This combined with my other disabilites, seperate from my 100% rating for asthma provided me 60%. Here are the questions that I have: 1. Do I qualify for SMC (s)? 2. Will I have to file a new claim or can I write my regional office and ask for it? Since SMC is a benefit and not a disabilty rating will I have to go thru the whole C&P exam process again? I coming up on my 10 year mark and don't want to do that? 3.If I do qualify, will I get any back pay? Thanks in advance...
