  2. Greetings to all: I am working with two Navy veteran's in my area. They have been trying to get CRSC for hearing loss. Their ships were in the Viet Nam waters/area. Both received Viet Nam Service Medals. Both veterans have been denied on two different occasions (initial and reconsideration claims ) for CRSC for hearing loss. Note. All other service connected disabilities were approved, with the exception of Hearing Loss. It appears Army(tanks) and Air Force (airplanes) personnel have been successful with their claims. Will CRSC for Navy Personnel with hearing loss, end up being another "boots on the ground" or "in country" fiasco?? Any recommendations or suggestions for them?? Thanks in Advance Doc
  3. Greetings to All I have a question/concern regarding evidence/forms and "date of receipt" at the VARO. My statement of case was dated 20 Oct 05. It gave me 60 days to file my appeal. With the sixty day rule to respond, wouldn't my response date be not later than 20 Dec 05. The VA is saying that my Appeal/Form 9 did not get to my folder until 30 DEC 05. Note: I have my USPS express mail receipt showing the Form 9 was receipted and signed for in the VARO mail room on 16 Dec 05 at 1010 AM. What does the VA regs say about "date of receipt" of mail. Is it the day it gets to the mail room or the day it gets to your C file.?? Will I have a leg to stand on trying to win this dispute?? Thanks in advance
  4. Greetings to All Does anyone know the quickest method to get copies of the veterans SSA Disability letter??? Is there a particular form number for this. I have tried the SSA 800 number, and ran into a "brick wall" as far as what is the best way to get copies of this. Does the VA have a direct line to SSA to get these files for IU claims, or should the Veteran get involved in trying to get copies of these. Your assistance in this matter will be greatly appreciated. Thanks Doc
  5. Hello to All I know there is no such thing as a dumb question, but as I look at all this VA stuff it really is confusing... I will be putting together my claim in the next couple of weeks, and I know I will need all the help I can get.. So I will start of with a few questions only. Question 1...What exactly is meant by pyramiding??? Question 2. Heart Issues) I had a heart attack, received stents, then ended up with 4 way bypass. Am I only allowed to file for one diagnosis under (cardiovascular system) Question 3 (Lung Issues) I have asthma, copd, emphysema, and sleep apnea. Again am I only allowed to file one diagnosis under (Respiratory) How does the VA determine which one to rate, or do I have to choose it? Thanks Much tgd2000
  6. Thanks Again Vike 17. Berta, I did get a VCAA letter and provided info as requested. I actually had "in country" duties, so the VA finally approved. I think initially the denials were based on my being Navy. I am keeping my fingers crossed that the blue water and brown water decisions are finalized shortly. My Prostate claim was filed 3 years after my initial diabetes claim. That was one of my reasons about asking about "re-opening" my Diabetes claim. It looks like my appeal could be a couple more years Have a Great Week-End!! Doc

  8. B) Greetings to All. I am a newbie to your site and have found great information as I reveiwed your FAQ'S. In Jan 06, I filed a claim for Prostate Cancer/Agent Orange, and was approved Feb 07. I have had an appeal going since Aug 2004 for Diabetes due to Agent Orange Exposure. The only update I get is the appeal is "still pending". My denial in 2004 was due to proving Viet Nam Service. Viet Nam Service was proved for PCA using the same info in my 2004 claim. My question is should I file again for diabetes, OR would this meet the criteria for CUE? Your assistance in this matter will be greatly appreciated. DOC
