  1. Good morning. This is "Mrs. Anthony" posting this message B) Anthony is not up to the computer today. We went to the service officer yesterday. He filed a "4138" saying my husband is disagreeing with the denial of I/U, stating the actual monthly income (which equals net yearly divided by 12) from my husband's self-employment for the year 2005 and the dollar amounts of our 2005 medical expenses. He said (in his opinion of course) the odds of I/U being granted are slim based on the fact that my husband is self-employed which shows he is employable regardless of the net income. (2005 net income is less than half of the 1 person poverty level) At least my husband tries to work and it is a shame that would be a penalty. It is time to close his small business I think. Said the "4138" would be reviewed by a DRO and the process should not take more than three months B) What a mess but we can only keep at it. Thanks for the information on this board. We will keep you posted. I think I will get my own Login today. :D :P
  2. We live on the Keweenaw peninsula about 2 1/2 hours NW of Marquette B) The finger of land that sticks out into Lake Superior. Supposed to have blowing snow this weekend with wind chills as low as -50 degrees. Snug as a bug in the house. Lots of snow - and I have a BIG snowblower with lots of extra gas. Snowshoes and no snowmobile - like the quiet in the woods. Have a wonderful day. I am feeling better knowing I made a clerical error on that form. Anthony
  3. Thanks for the reply and the links to the websites. I have bookmarked them and will check them out. B) My CRDP is taxable. I will post what I find out next Thursday after a trip to the VFW rep. He only wants me to provide 2005 net income amount what I put in my pocket, medical expense amount for me and my wife - he said down to the asprin bought across the counter and my DD214. My business gross was less in 2005 than 2004 so my net is less.....the poverty level guidelines are helpful Will let you all know what happens. Anthony Michigan
  4. Thanks for the response. I now know I completed the form incorrectly thanks to the responses I have received. I did put my gross income not net income after business deductions etc. on my 8940 which I filed in August 2005. Denial came back January 2006. I included my Schedule C which clearly showed the net income but whomever did my file did not get a red flag or they ignored the red flag - that something did not jive. I guess that does not surprise me. I have an appointment with a new VFW rep in Marquette MI this coming Thursday to file an appeal. After speaking to him on the phone today he made me feel so much better. He said there is no doubt there is an error and to see him ASAP so he can file the paperwork correctly. The new rep did also say the original VFW rep should have caught my error - the original rep said GROSS income I will keep you posted as to the results. Many thanks for your help. Anthony Michigan

  6. I accidently posted my question in the wrong forum so I am reposting it in this one. B) I am rated at 70% and was sent VA form 21-8940 for Indiviual Unemployability to complete for verification of income and VA form "Employment Questionnaire". I am self employed and don't know what amount should be put in box #16 item F on the Individual Unemployability form? Is it my gross monthly income for my business before expenses? or what I put in my pocket after expenses? On the Employment Questionnaire what would go in box 4F? I was told by a VA employee at the regional office in Lansing MI that the dollar amount the VA looks at is my net income after expenses. I was told to also send my schedule c from 2004 - it shows a net income of $3,882.00. My total business income before expenses was $15,100.00. Do they caluculate in my VA benefit and Navy CRDP as income? I am confused. My vet rep said he thought it was gross income overall. Any help would be appreciated from anyone who knows how to fill out this form. My wife and I think we did not complete it correctly and we are receiving conflicting information from the VFW rep and the VA office. Thanks for having this resource available. Anthony

  8. At the VA's request in July 2005 I went for my review of my disablity. As a result my rating went from 50% to 70% and I was asked to complete the application for IU since my disablity affects my employment in the main stream of society. I am self-employed with a net income in 2004 of $3,882. My schedule C was attached to the application. All questions honestly answered. I have heard nothing from the VA as of today but tonight checked my "RAS" online and my pay has been changed. My VA Waiver is less than it was at 50% and now I have taxable income effective Nov. 1, 2005. What happened? Too late to call my VFW rep today. Any input would be appreciated. I am really stressed now. Thanks for having a place for vets to get the info they need. Anthony
