This message is in response to your inquiry dated April 2, 2010. Our records indicate that you are rated at 90%, being paid at the 100% rate due to individual unemployability. You are not currently rated 100% Permanent and Total (P&T). We are very sorry for any confusion. Veteran's receiving individual unemployability are the exception to the rule that a Veteran must be rated 100% P&T to receive Dependents Educational Assistance (DEA) benefits. Because the unemployability benefit can always be taken away if the Veteran begins working again, the rating can't be made permanent. Also, unemployability is granted to Veteran's rated less than 100%, so their rating isn't total, total being 100%. With no chance of of the rating being permanent, there is no way to grant Permanent and Total.
I will never call 800# or IRIS again they make up there own rules "EXCEPTION TO RULE FOR DEA IF YOUR NOT P&T but are IU .i never heard of exception.
