Well in my case, they got the claim 14 June 07 and I just got the decision on 4 Feb 08. They all take different amounts of time. Dependes on the amount of claims, severity, back load of work, and other factors involved. I hope it goes quickly for you.

As long as you were able to comply with what they asked for in the VCAA letter and you sent them back the VCAA election notice and checked box one or two-

then per the VA- the claim should be with "a rating specialist 14-20 days" and take about 170 days from start to finish-

this astonishing statement is within VA testimony from Feb 14th at :http://veterans.house.gov/hearings/hearing.aspx?NewsID=189

you can go to Audio and listen to this hearing.

It was in Room 340

The VA guy said 8-10 days for Triage cotrol, then Post Determination team30 days unless more development is needed,60 days more for ALL evidence after receipt of VCAA response (if you actually get this form),rating specialist 14-20 days,Post determination Team-15 days-

and he estimated 170 days as usual amount of time for processing the claim from start to finish-

I got some real good laughs at his testimony-

Do they have VAROs on the Moon?

Then again the VA is bookin these days- I can see it within the movement of my own claims-

They did more in the last 5 months then they did in the last 5 years-

Of course I have no idea if they have even attempted to read my evidence yet.But it sure is moving -went to Raters for the 21st time since Jan 2006

PS- Please dont think I am trying to discourage anyone-

I have seen this same RO make plenty of fast and proper decisions-

My AO claim is based on additional malpractice on top of what they already admitted to under FTCA and 1151 - that does not make one too popular with the VARO-

Also in my C file is a BVA decision that states emphatically that with a direct SC death award the VA has to release a large 5 figure award to me -right away-

that too doesnt make my claim too appetizing to them-

when I consider those 2 facts - this makes my claim much different from many claims here-so no wonder they are stringing it out-and ignoring my IMOs-

Please dont be discouraged-by my story- I'm not-

I like fighting with them because I learn more every time I do-

But when the RO strings out perfectly valid claims I see here-fully supported by med evidence-

and they do this often by defiance of the VCAA-

that is a Big mountain for a claimant to manuever over-and this violates every right we have in 38 CFR-in a snowball effect -when they deny us the inital DTA rights we have-

still the VA is trying to sell some facts and figures that simply are NOT true-

and even documentation itself available on the net shows these estimates realistically do not apply to thousands of claimants-

(as those remands at the BVA reveal)

In my case I have one of those files that are about 13 inches thick. Mine is usually the last one they will work due to the work load and being required to do a certain number to keep the higher ups off their butt. I would do the same, do the small one claimers and be able to do a lot of them. I think that they are not required to do them in the order they come in. Having said that I can't complain, some decisions came fast some are still pending.

So how long does it take is a WAG(Wild A$$ Guess). Having patience is hard to have but a very needed commodity.

PS, Berta you are my hero!!!!!! keep their feet to the fire.
