Anyone Been Told About This

Question

Went to our attys. office the other day- asking them what is holding up the new CP exams since the BVA remand-

they said they were told there is a doctor conflict at the VAMC here- but they wont tell them about what--so we wait again...................Anybody got ideas?

Ask your Service Officer to find out for you.

That sucks

I would also ask for a copy of C&P and tell them to use it if it helps and if it does not ask for a new C&P

They can't schedule another CP exam yet because they said there is a doctor conflict at the VAMC here- In the BVA remand they want another PTSD CP exam-because the IMO and the VA examiners report had a slight difference in opinion-go figure....I called the CP scheduling #here and they said they can't schedule until Philly RO lets them know to do so..they told me to call there, I told the lawyers to call- and they told them there is a doctor conflict at this VAMC here...they've admitted PTSD-verified stressors the whole thing..etc..blahblah..so no exam until this gets resolved..there

If you have a private shrink on the payroll keep them handy. If the VA gets around to doing another C&P exam you may need your own doctor to contest it if they low ball your percentage. You can't just let the VA rate you based only on one of their C&P exams. The C&P doctors seem to always steer their opinions away from a permanent disability and they see things more optimistically. These things usually boil down to who can last the longest. You don't really want benefit of doubt. You don't want there to be any dobut.

The addendum we sent a year ago before the BVA hearing contested the CP exam report- because my husband met all critieria except for Factor C- they are using that as weight- against the postive 2 IMOs and the SS IMo which granted him disabled for Ptsd - and the 1st VA SSOC in 05' already said "you have been diagnosed with PTSD"/then the in absence of verifiable stressor service connection continues to be denied---then in 07' they say"VA notes that you stressors have been verifed" in but "you have not been diagnosed with PTSD" you have "variuos psychiatric diagnoses "/then after BVA hearing- remanded appeal for another CP exam-because of conflict in the IMO and CP exam statements--NOW THEY ARE SAYING THEY CAN'T SCHEDULE EXAM, BECAUSE THEIR IS A DOCTOR CONFLICT--BUT THEY WONT EVEN TELL THE LAWYERS WHY---

I SMELL SOMETHING FISHY..........

Yes, this is fishy...you have PTSD but no Stressors, you have stressors but no PTSD. This is with the doctors at the same VAMC? What VA is doing is doctor shopping to get the opinion that will deny your claim. They may even declare that the codition doesn't exist at all since the doctors are unable to agree. You are in a pickle and it may be time to get your Congressman involved here...a congressional inquiry is the VA's worst nightmare. See what others have to say about this.

THIS HAS BEEN GOING ON SINCE 03'--THE SOC ADMITTED DIAGNOSES OF PTSD-3 IMOS-THE VA EXAMINER OF COURSE AND THE PRIVATE IMO DIFFER-BUT THEY ARE TOLD TO DIAGNOSE S MOOD DISORDER NOS-EVEN THOUGH HE IS ON SS FOR PTSD-

THEN THEY VERIFIED STRESSORS SSOC AND CHANGED THEIR MIND BECAUSE OF DOCTOR CONFLICT VA CP EXAM AND IMO-AND YES CONGRESSMAN HAS BEEN INVOLVED FOR 2 YEARS AND ARE ABOUT TO BE AGAIN--WE ARE IN THIS 11 YEARS
