I got a claim back for my tinnitus 10%. They placed the effective date 6/2/10, the initial claim was 8/22/08. I didn"t get a C&P exam until 2/10/10.

What circumstance cause the VA not to used the initial date of the claim.

I am a little confused 06/02/10 has not arrived yet. If your claim was closed (meaning no appeal within 1 year of denial) and you submitted eveidence to reopen it. The effective date of the claim is the date it was reopened.

1. The RO screwed up. (Typical "honest mistake" that costs a veteran money and time to correct.)

2. The RO hoped you would not notice?

3. The VA likes to minimize or eliminate retro pay whenever it thinks it can.

4. The RO might say that there is no creditable evidence until the C&P was accomplished.

5. And so forth--

It's NOD/CUE time for you, my friend! About four years from now, you might get the retro pay.

You might also consider asking your senator to have a letter written asking the VA to explain the 2010 EDD determination, since the claim was dated in 2008. It may speed things up, or not, as the VA wishes. The 6/10/10 date is an obvious mistake.

Sgmdae, was this for increase or NOD? What did the decision say, sometimes noticed decisions and dates don't always match up between the award paperwork and decison statement.

file a NOD
