Another Success, But More To Go

I retired from the Navy in 2004. I originally applied for VA disability and was granted 60% for sleep apnea, arthritis, tinnitus and cubial tunnel. I was denied hypertension, which I appealed and won a couple months later for a 70% rating.

Annoyed by the fact that CRDP would not be paid retroactively by the VA (since DFAS has paid their share), I appealed the decision for back pay of CRDP. At the same time, I also filed claims for depression, acne and neurolegia in my thigh. Today, I received notice that my appeal was granted with a 90% overall rating. I am still waiting for a BVA decision for the back pay.

While I'm satisfied with my rating, I am very dissatisfied with the failure of the VA to recognize that CRDP applies to the VA as well as DFAS. I sought help from TREA, but they simply could not grasp the concept that concurrent receipt applied to both agencies. So, I contacted the DAV. They simply never returned my calls. So, I contacted my congressman and senators. I've gotten some letters, but nothing has been done.

If anyone has any advice for me, I would appreciate it.

Rusty-there has been much discussion on these programs at:

http://www.veteransresources.org/forums/ar...x.php?t-61.html

For the CRDP issue- I know TinCAnMan from hadit or somewhere and I think his post above makes sense-

as to the VA contacting DFAS-

Here is the site's Home page to register:

http://www.veteransresources.org/forums/index.php

Also we posted info at hadit in the past-and it can be found under the Search feature-

The Veterans Benefit Network has a discussion going on this issue too:

http://p203.ezboard.com/bvetbenefits

under Retired Military and also the CRSC forum-

I do not mean to push you off to another web site- not at all-glad you are here - but I felt that here are some vets going through this process and they are having a current discussion about it-

Meantime I hope someone will chime in from hadit who has been through this CRSC-CRDP issue-

I think it is very confusing and has been right from the git go and

-as one of the vets at VBN or military.com said- even the guy at DFAS couldn't answer his question-

The VA web site refers one to:

http://www.defenselink.mil/prhome/mppcrsc.html

for a full explanation of these benefits.

Anyone out there had experience with CDRP who can help this vet?

I will attach the DOD explanation of these benefits and the update of 2005.

Rusty:

If you are over 50% and you are 60% they have to pay no questions asked. It does not have to even be for something related to your Service Connected Disability.
