Denied Fibromyalgia And Ibs

I found out yesterday I was denied for fibromyalgia and ibs. I was in the gulf war 90-94. I put in a claim for presumptive. I had 2 dbqs filled out from specialist and all my medical records sent in. I called the ro to see why it was denied. First he said because there was nothing in my military records. I replied it is presumptive because I was in gulf war. He put me on hold. When he came back he told me the doctor who did the c+p linked it to another illness. I told him I saw the c+p and the doctor never mentioned that. She actually backed up my doctor diagnosis by finding all the tender points. He then said he would call me back. When he called back he told me there was nothing he could do because the claim closed. He told me to fill out a nod form and email it to him and he would expidite the appeal. He said he couldn't guarantee it would be approved but he would have someone else look at it. Does this sound fishy to anyone else?

If you file a NOD it starts the appeal process and can take several years to be reviewed or solved. Yes, this sounds very fishy.

He told me to fill out a nod form and email it to him and he would expedite the appeal. He said he couldn't guarantee it would be approved but he would have someone else look at it.

This statement lets him off the hook and you will have to wait until the NOD is processed in regular time which is several years down the road if you fill out a NOD. I agree with P. R.

Here is the thing. I emailed hickey a few weeks back because my claim wasn't moving. The ro called me and said hickey talked to him and told him to look at my claim. I was then scheduled a c+ p exam and then in a couple of weeks had the decision. When I mentioned I wasn't happy with what happened and I am going to contact hickey again he said he would call me back. After he called me back he then said he would expidite the nod. So I am torn with emailing her again or seeing if he will expidite it first and if he doesn't then emailing her

This is IMHO that VA does not know how to expedite anything. I may be totally wrong and off but a few times I tried to get VA to move faster it ended up back firing and I got a denial letter and years of appeal time waiting for them to get their stuff together. It is up to you. The ball is in your court just remember VA does not play fair. That NOD can take years or you can send another email to Hickey but not sure if she can really do anything.

Email a NOD if it doesn't seem to be going anywhere, you can always send another email to Hickey. Just my opinion, If they realize they made a mistake they may fix it, in the hopes that it doesn't get back to management, Keep in mind the 1 year appeal time frame. Make sure you file a NOD if it hasn't moved by then.
