Denied Fibromyalgia And Ibs

Rate this question

Question

I found out yesterday I was denied for fibromyalgia and ibs. I was in the gulf war 90-94. I put in a claim for presumptive. I had 2 dbqs filled out from specialist and all my medical records sent in. I called the ro to see why it was denied. First he said because there was nothing in my military records. I replied it is presumptive because I was in gulf war. He put me on hold. When he came back he told me the doctor who did the c+p linked it to another illness. I told him I saw the c+p and the doctor never mentioned that. She actually backed up my doctor diagnosis by finding all the tender points. He then said he would call me back. When he called back he told me there was nothing he could do because the claim closed. He told me to fill out a nod form and email it to him and he would expidite the appeal. He said he couldn't guarantee it would be approved but he would have someone else look at it. Does this sound fishy to anyone else?

I am quoting here and I don't remember who said it but I read it on hadit and it makes a lot of sense to me. The statement someone said in a post was " if it was not read it was not said". I actually do not like talking to VA on the phone. I have concentration and memory problems. I do remember getting an early call from VA asking me about one of my claims. This call was like 7:00 am in the morning and I had a rough night sleep. It is even in my VA/medical records that I have both sleep apnea and insomnia. But when the call came I spoke with a VA representative for thirty minutes or so and I went back to sleep. When I woke up I couldn't figure out if I was dreaming or if I actually talked to someone. Not more than three days later I get a big O fat denial in the mail. Believe it or not I realized I did talk to someone and I even wrote her name down but I was so out of it I had no Idea of what we talked about. I had filed for financial hardship and VA was to expedite my claim. If a VA employee ask for something from you or tell you to do something and they will expedite it or try to help, make sure you ask them to put it in writing and mail it or email it to you before you do anything. It is very sad that you can't trust them (the VA) and they definitely don't trust veterans.

Yes. I was seeing my gastrologist for 3 yrs and rheumatologist for 1

Because with the GW exam there is language attached to the request in order to get the GW opinion. You may be better off going to the VA exam.
