Receive SSA for PTSD denied IU

Question

My husband is retired and is currently receiving SS disability for his PTSD/MDD/TBI/headaches. Applied for IU and it was denied. I don't understand how the IU was denied when he can't work and was found unemployable by Social Security for his service connected disabilities? VA's denial letter did not reflect SSA documents that were sent in.  My husband was found unfit for active-duty.  He went before a PEB but because he was retirement eligible they did not approve a med retirement. VA awarded him PTST/MDD/TBI 50% and 30 for headaches and a few other issues for combine rate of 90.  Any advice for IU appeal?

NOD the decision. Ask for reconsideration and send the SSA decision to the VA. 

This may help. You may want to bring in an attorney.

Was his SSA award based on PTSD or all of his SC disabilities.

This is likely a delay tactic on behalf of the Regional Office.  They seem to do this a lot.

 

You may want to also consider emailing Allison Hickey and ask her for her assistance.

For some reason the Big Veterans Service Organizations are trying to oust her again. She must be doing something that offends these orgs.

After re reading your post, Do me a favor and call Alicia Guidi at Bergmann Moore.(877) 838-2889 The are working on some issues like your husbands. Tell Her John From the Hadit Radio Show told you to call. The VA is lowballing veterans who have TBI ratings to get out of paying the correct Sopecial Monthly Compensation.

Thank you John. His SSA award was based solely on PTSD MDD TBI and headaches. I did submit his Social Security documentation on his original claim back into 2011 and SSA documentation was also submitted on his IU claim back in Dec 2012.  I have an appeal on original claim and an appeal for the IU  and resubmitted the Social Security documentation again for both claims.
