Oiler1995 Posted October 3, 2015 Share Posted October 3, 2015 My uncle just got awarded 30% for ptsd today.He is a Vietnam veteran,but never received care from the VA since leaving Nam.All his care was outside doctors and hospitals,he has been diagnosed with major depression and has been fighting it ever since leaving Nam.He has been on meds ever since.Plus he has had 12 shock treatments.Alot of his outside medical records could not be retrieved because they told him they don't exist anymore.I feel he deserves more then 30% ptsd,can he reapply or appeal,thanks. Moderator broncovet Posted November 15, 2015 Moderator Share Posted November 15, 2015 Yes, he can appeal. With the exception of delays and denials, the VA's favorite is lowballing. Did his decision give a reasons and bases for the 30%? What were their reasons? You are going to need to get copies of all the records available, including the doctors. Then, you can compare the symptoms the doctor reports with the rating schedule for mental disorders. Is your uncle working? Remember, Va is compensating him for "average loss of earning ability", so if he is not working and not employable, then he should be going for 100% or IU.
