21 Million VA malpractice payout

The worse thing any vet or their spouses or survivors can do is to feel something was not right with their VA health care and then do nothing about having a real IMO doctor go over the medical records.

It is an expense that may or may not reveal substantial malpractice but ,one way or the other ,that IMO will give them Peace of Mind.

The link holds the pdf of this case ,won in the Federal Court.

I have not read it yet. Either the VA's settlement offer was not acceptable or the VA might have even denied the FTCA case...

The veteran is still alive, but his wife apparently filed this action against the VA , due to malpractice on the veteran's initial stroke.

Dang it there going to use up all the $$$ and we won't have any comp left  dang   Idiots!

if something wrong with my healthcare and tell the VA and nothing is done I go to a private Doc and pay.

I need to add something here....over the years at hadit sometimes we are given info and  even med recs are attached here that seem to reveal malpractice /negligence on VA's part.

Some have seemed to be  obvious situations where something has gone wrong in the veteran's care...based on what the attachments reveal and what the veteran or their spouse or survivor posts...but that is few and far between.

And these types of claims whether FTCA or 1151 or both, will still need an strong IMO to succeed.

Recently we had a situation whereby a survivor seemed to be asking for support of negligence based on some records she had attached here.

I can understand why anyone would want some positive opinions that there could be malpractice on VA's part, before laying out IMO money.

But none of us are really qualified to do that .We can certainly opine on what seems to be unusual in the veteran's care, based on what we read here,  but this type of claim really takes a good review of every single medical record, not just a few,  because initial malpractice ,

which can be very hard to assess by a layperson, has a paper trial that lends to subsequent other erroneous medical decisions.

Its a good Ideal to keep all your VA Medical Records   in a safe place  all of them no matter what..

just incase you need them some day.

21 million is not a lot to VA.  They wasted 100 times that much just on the Denver Hospital.  Also VA has about 500 lawyers, who do nothing but try to keep us from getting benefits.  Each of those lawyers makes at least 100k with benefits, so that's at least 50,000,000 per year squandered by VA for no good reason.    The VA has the gall to tell us we dont need a lawyer, when they have 500 of them lined up against us.  If we dont need a lawyer, why does the VA just not use VSO's to fight us?
