ptsd Inadequate C and P Exam

I had my C and P Exams yesterday at VA Clinic in Pensacola Fl

None of the three examiners had read my C-File. Two were pros. The Mental Health examiner was unprofessional, condesending, brusque and out of sorts. She did not follow VA policy re using a checklist or template like DBQ. She was incredulous at my claim that I held in my trauma and mental health for 40 years as I protected my 27 career as an officer. Yet VA has conducted Vietnam Studies that show chronic PTSD in Vietnam vets and that there is now a surge in Vietnam vet claims. 

 

What or how to I file a protest against the examiner before VARO gets her report?

If you do not have a veterans organization representing you, that is the first step. Your story is pretty much the norm. They deny you and you have to file appeal after appeal. However, you do not know these people and they could come back and award you. Basically, you can not do anything to an examiner. They work for the VA and no one gets fired. Play the game better than them.

Glad to see you made it thru your exams. Try not to worry, cause no matter what the Examiners opinion is, the VA and RO should go off of the Medical Evidence submitted. Post the C&P exam notes on here and we will give it our best. Good luck and keep us posted

wait until you get your decision???

you don't know what that is just because you may have had a bad examiner?..., if you get denied read the bases and reasons they denied it, then file an NOD and ask for a DRO Hearing at your RO.

That is the fastest way in my opinion.

If you have the examiner's name, do a little Internet digging and find out their curriculum vitae....might be helpful later on if you file an appeal and need to compare their experience to your own IME/IMO doctor, especially if they are just a nurse practitioner or physician's assistant.  Just a thought.  Good luck!

I did just that and bingo she also works in a local prison and I found her PhD dissertation. Seems she is an expert on criminals manipulating the system to avoid prosecution....jeez. Now I know why she treated me like dirt. Believe me I will use this on appeal.

I'm sorry your C&P examiner was a total jerk. It is not uncommon to encounter an examiner who is not pro-veteran. I had a poor C&P examiner back in the day and appealed my denial to the BVA. The result was a new C&P exam with specialist.

What is their medical specialty? If it is for PTSD, the VA is supposed to provide a psychiatrist or psychologist, not a general practitioner or other doctor.

Request a copy of your C&P exam findings first. Also, check the PTSD DBQ on the VA web site to see if they appeared to have followed the instructions. Sometimes examiners do not think the rules apply to them.
