RUREADY Posted February 6, 2016 Share Posted February 6, 2016 (edited) This is something I didn't know that BVA can't grant a claim for Extra scheduler 4.16(b) until the AOJ first has to summit it to the Director Of Compensation and if denied than BVA can decide whether to grant it or deny It because the Director decision has no effect on BVA decisions. BVA has the power than to grant it but only after your RO ask for extra-scheduler I think that's why my remand is for ever My RO never did this with my claim. My point is this RO screwed me good, in all my decisions since 2003 I have ask for 4.16(b) and I always get the same answer 4.16(a) one disability has to have a 60% rating or two disabilities one rated at 40%. It took these MF 13 years of appealing to the court and now they still have to do the same shit I ask for in 2003,4.16(B) it doesn't say it has to be a certain percentage just you are unemployable from a service connected disability. Don't get caught like me with this RO bull crap just keep waitng for them too do the right thing. My attorney is Hill & Ponton one is a member of Hadit that's my attorney he fight hard for you no up front fees and he has went to court and back and still with me at BVA most quit after they get the fees from court but he is still helping.
