The only thing I can see about it  being eligible  if the vet has a COUNTABLE income a disability income and not pension  then it excludes the veteran from this benefit.

 It is paid in addition to a veteran's basic pension. The benefit may not be paid without eligibility to a VA basic pension

I think what the VSO meant  if your on SSD then that's excluded, but pension and compensation are two different  type benefits

I don't think VA disability Compensation would be consider VA Pension?

so my countable income from my VA SC Disability would exclude us from this A&A benefit.

which don't seem right to me but that's how I see this.

Next Time I have to go to the VAMC  I'll go see this VSO he was at the VBA Office.. I just have to wait my turn to see them.  & your right he may thought I was on VA Pension   but then again I was there getting my C&P Report

Oh well if a veteran has to be getting a pension  and  VA Compensation is not consider a pension  then that knocks us out of this benefit.

Buck, I know what  you are seeking. It is available as Aid and Attendance for your spouse. It doesn't hinge on any income requirements or SSD. I did one for a Vet in Colorado several years back. She fell and broke her hip and was permanently laid up in a wheel chair. We applied for A&A for her and it was granted as my guy was 100% toast and on A&A as well. I'll have to look up the regulation but it is not a pension-specific benefit.

Your wife will have to pass the Form 21-2680 test for the Aid and Attendance so you can review it ahead of time and see if she can qualify.

I found this case at BVA, but no regulation in it.

The spouse was receiving A & A. The vet was SCed.

I still cant find the regulation.

I think were not going to be approved/my spouse has her arms and legs and can see but has to wear eye glasses,

 I'm not sure what her eye site numbers are but she can't see without her glasses, she has Osteoporosis real bad in her spine bones and neck area she takes treatments for it and boo-coos of meds, its all she can do to do chores here at the house.

 she is on SSD ..And gets 1.52.00 Per month and from what I get from VA  Puts us over the Income limits according to the VA.

I think that VSO is full of it.  eh!

I help all  can but the two of us really need to hire some help if its just for house cleaning...other wise she could damage her Back even more, she does have a electric wheel chair we purchased at a  estate sale last year.

just cutting up lettuce for salad takes its toll on her,  she goes lays on the heating pad most of the day.  just ordinary little things we take for granted  is very hard for her. '' even just walking'' its a killer for her to go to the Dr's getting in and out of the bed is hard for her  and walking, nothing is easy for her  just getting in bed is hard I help her all I can.

she also had a seizure and takes meds for that that swells up her face...plus she had triple heart by pass & she has left main disease also.

if she was a veteran she would  be over 200 plus% SC

she gets ChampVA FOR THE 75% and using Sellman Insurance  from Retired Military Veterans or 100% SC Disabled  for the other 25% that champ don't pay..but it takes all we have coming in...she sees 5 different Specialist Dr's  not including the VA  almost 2 to three times month. were both on Cpap machines..looks like a nurse's home room in our bedroom...I guess that's what happens when we get older  eh!

SHE HAS SEVERAL DISABLING Ailments to many to mention.

Were not going to pursue a claim for A&A because the requirements are to strict.

she helps me do the things I can not do anymore and I help her  ''try to'' do the things she can't do anymore or has a hard time with it.

Oh well I am still going to try to find out more about THIS   but the form 21-2680  seems they want half of you in your casket...were both not ready to do that just yet.

I truly want to know the Regs on this  it be good to know.
