Question

I dont need to sound like an idiot but I cannot figure out how Im requesting P and T with the correct form. I thought the person said it was 21-526EZ but there is no block to check or no statement to enter it in requesting it.My recent neurologist has agreed that 11 years now my residuals are definately permanent now I just have to maintain treatment and change habits to make my life sustainable. What is the proper way to fill out the form on ebenefits? Do you just attach a letter with the claim the last time I did they denied saying I didnt request with the proper form....

I BELIEVE THE 21-526 EZ is the form, just attach your statement from your Dr. opine that your S.C. Disability is of nature or static and not expected to improve in your life time.

and a lay statement from you describing why you feel like you should be awarded P&T 

Because basically this is a Request for Increase.

There use to be other forms but the 526 ez is basically the form for all claims now days.

There are many variables that every veteran must consider when contemplating whether or not to seek the assignment of permanence. Each vet must carefully review his or her own circumstances. As a general rule, the permanent rating will provide significantly better benefits for dependents than a temporary rating. However, if the veteran isn't well prepared when asking that the rating be modified from temporary to permanent, there is some risk. Seeking to change the status of your award from temporary to P & T is the same as asking for an increase to an existing rating.

I would say most veterans that are P&T rather or not 100% OR IU they usually inferred the P&T when they look at the  severity  of the S.C. Disability at the time of the Rating.

but some times they over look it and the Veteran needs to Request it..and as long as your Dr will opine about your S.C. Disability then  usually its not a problem.

So i don't get confused Buck52 I go on ebenefits file for a new claim I was going to file a new secondary to my sTBI and an increase in my headaches. For my evidence attach the letters from my Neurologist and i was going to submit evidence the VA doctor also opinioned about my childhood ADD being exacerbated by the TBI and wants to try putting me back on Ritalin as I was when I was like 10 years old discontinued using before high school. Was an honor student  in High School was a class leader of my Mos school in Pensacola and also recieved Marine of the quarter just two weeks before my sTBI. I never returned to that cognitive function but yet they kept me in because I wanted to be a marine and physically I was able to pass a 1st class PFT 4 months after being in a month long coma. 2007 they mentioned my ADD in my neuropsych after my TBI and then again in 2010 when exiting before the VA service connected my TBI they diagnosed me with it in 2011 and tried Strattera but had to discontinue because of the fatigue side effects that was counter productive with my TBI. I know SC for ADHD is supposively impossible but when I have had several VA doctors all opinion my TBI has neurocognitive deficits and it also has ADHD from his childhood exacerbated by his TBI. I figure maybe I should file for it now the doctor just opinioned it again one week ago don't think it can hurt I'm already 100% IU now.

 Yes your correct in filing  secondary  & attache your attachments, Normally speaking the VA will try to use your childhood disability to try to deny (anything) but if you have the opinion of a qualified Dr about your in service disability or  from your TBI that occurred in the military or likey as not occurred in the military  that should change things  they can't possibly rate the ADD & the TBI together or use they may use  childhood ADD against you,  if they do I'd fight them on that. I believe your Dr would help...so be careful about submitting anything like ADD from your childhood days..unless your Attorney or Rep thinks its  good to do that.?

I would disagree with it.

As for as them rating you  let them figured it all out  but you can look up the severity of your symptoms and see what that rating should be to keep from being low-balled. 

Being an honor student is fine  but the VA don't care about that..they look deeply in the medical records.

Medical Records are the Heart and soul of winning claims...and how a Specialist Dr words it and what he/she mention carries some big weight.

other member's can chime in here  because I don't want to give you false infor or bad advise.

this is just my opinion.  I am not that famiular with the TBI's

More then doctor had opinioned about my ADHD being exacerbated by my sTBI that is service connected it already has PTSD sleep disturbances and cognitive disorder under its rating for the residuals of my TBI

hopefully this means not much longer I'll know if I was going to submit the doctors from my SSA TBI exam which said I can't  work due to my cognitive and functional impairments. I just hope the doctor agreed signed off on the DDS evaluation. Because an approval would benefit my Permanent and total claim I've been waiting to submit because of my SSA claim..Hate anxiety and insomnia won't be fun tonight
