Bad Legal Advice?

Question

I have a hearing loss claim on appeal.

Attorney suggested we drop that claim as the compensation will likely be 0%.

My idea is hearing loss progressively worsens over time and at some point will require hearing assistance medical devices as I age.

As that happens, I could submit new claims for an increase.

Personally I think it is worth fighting for.

Don't drop it.  I am service connected for hearing at 0%.  I have that and about 6 other 0%'s in my back pocket.  You never know.

I am 10% for tinnitus of the left ear.  Got that right when I got out, and part of my first claim(s).  I think it is easier right away than later, but should be do-able.

One problem with hearing is it gets worse as you get older anyway, so, you need before and after comparisons I would think.  Do you have a hearing test from your entrance exam into the military?, and then after?

Hamslice, yes, the evidence  in my claims file is very favorable which didn't seem to matter at all.

Every single one of the examiners should be put under oath and recorded to stop the lies which harm legitimate claims.

 

If a veterans lies, we are subject to prosecution.

So, that being said, the examiners should be held to the same standard as the veterans.

 

There is no accountability with the way the VBA is ran.

yes and thats a shame

But we can get private specialist to rebut against those lying examiners and prove them wrong...it don't make an VA Examiner look to good but VA could care less it seems.

Hearing loss claims and veterans with problems with R.O.M. Range of Motion & Pain is a big problem with some examiners.

Just my opinion here but if a veteran gets an C&P Examiner that has a predetermined mind   usually he looks for something in the records that is detrimental to the veterans out come of his claim and knows the Veteran will be denied  before the Veteran finds out.

maybe the examiner gets a thrill to mess up a veterans claim...eh!

I like your way of thinking, examiners being held accountable and being subject to prosecution.   Wow then Veterans might have an honest go when they file for benefits.  Man could anyone picture the headlines. "  VA doctor caught in lies, looses medical license, and serving time". I would smile to see that on headlines. :biggrin::lol::biggrin:

If that day comes it man, it would turn things around. Until that day though, "we" will just have to keep having Had it and other resources like this in play.  Knowledge is a strong weapon to have in the arsenal.  JMO

IF you get denied because your hearing isn't bad, you'll need the infamous 'N&M' to reopen.

As ham says, it gets worse as you get older, so THEN is the time to file.

Ask the VA to put a rating on those zero's. They need to assign a rating when the number of zeros goes over a certain number- And, yes, they can rate all the zeros at zero :(
