Comp & Pen details tab
Just wondering what this might mean on va. gov, comp and pen is showing Awaiting Release of funds- SSD and details show Attorney Fee Memo- AAFC Authorized Award (New). I use DAV as my Rep. I don’t understand SSD, is it possible the DAV signed me up for Social Security Disability? Just wondering what all this means, could be an old lawyer just trying to squeeze more money out of me!

ebenefits accuracy
I filed three claims, an increase for tbi, increase for migraine, and a new claim for tdiu. VA.gov shows claim complete and ebenefits show tbi increased from 40 to 50 percent, but nothing on the migraine and tdiu claims. Ebenefit shows no pending claims for claim status. Does this mean that tdiu and migraine increase were denied? Also shows notification being sent.

Case close for increase claim
Hello everyone, Happy labors day to all, so my question was i my current disability is rated at 50% since last years, since then i haven't seen any improvement myself, I haven't work much or able to keep a stable job, my last job was at home depot for prob 2 months as a greeters around the end of 2019, I just submit all my disability for an increase on may 2020 and my case just close on September 3rd 2020, when to only 1 C&P exam where the doctor just ask me about my injury and how it feel about it, if i pull any muscle or tears any thing, i told the doctor it just hurt when walk or stand, some flare up sometime on my knee. so i limited myself to mostly sit or la…

Disappearing Claim
Anybody ever have a new claim disappear off of eBenefits completely? I filed a new one based on information received from my SMR's when I received them from the National Personnel Records Center. The VA was supposed to have retrieved them under the VCAA, but they were never in my C-FILE, so I obtained them myself and filed them with the VA. I filed the new compensation claim in August, 2014, and it has been sitting on idle in Under Review for several months until a couple of days ago, when it disappeared completely. All other claims and information is still there. Anybody have this happen? Mark

ERROR CODE ON EBEN EVSS_10021
I have submitted my claim well over 9 months ago. I have completed all C&P Exams, and now when I log on to ebenefits I get an error code that says EVSS_10021. Anyone have any idea what this means and or if there is a way to fix it. I can see my claim, I can't upload, I can't view anything. Any help would be greatly appreciated.

Disability list
Anyone know how to get your current disability list on either website? I’m on an iPhone i Have figured out you can get to it you going to payments information and the then click on additional benefits, but other then filing for an Increase to see the list and The decision letter isn’t there one you can download?found it so I’ll post it for iPhone users in VA.gov under benefits menu....

Claims
I recently, (April 2020), filed for an increase of a disability rating that was rated at 0% at a service connected injury in April of 2004. Will I potentially receive back pay to April of 2004 if this disability increases to even a 10%? Or will it only be back pay to my second file date of April of 2020 if it is increased? Thank you

High Level Review Closed
I have been trying to get my Sleep Apnea service connected for months. I did a high level review from my C&P case and they just updated va.gov with a status of VA Identified an error that must be corrected VA corrected an error and made a new decision Current status is the VBA made a decision, read decision letter for more details. It says currently on review is "Compensation Issue". Ebenefits shows no change but should I give it another day or two before I decide that they denied my appeal? Thanks!

ERROR for filing new Claims?
not really ebennies anymore but VA.gov i am trying to file new claims through the site. i guess i could have gone to my VSO to file the claims but i had all the paper work needed for my claim and just wanted to get it done. so long story went through the system and went to submit a claim and got this: anyone know what this means? there is nothing to indicate what i am missing or what is "not valid" when i go back through all the questions. i am lost. HELP!!!

Ebennies Re-routed to VA.Gov
guys this may not be something that anyone can answer but i wanted to see if anyone else is having the same issues or having the same problems with getting updates on their claims. i used to be able to track my claim status with ebennies(and granted it was flawed system and not trustworthy dates) but it was something. now i have the below screenshots. all my claims are now on VA.gov and all my claims are saying "we dont know your status" for over a year now. i have called the 800 number i dont know how many times about this and no one there can give me an answer so thought i would get with you guys. its been a while since i been on here but i did have my appeal hear…

Ebenefits timeline/update....
Just an FYI. Ebenefits is updating daily with any new info on your claims. As of today, (i am an habitual checker, multi times a day) well for today my site just changed and my claim is now closed INCLUDING the remand and it was service connected. No new letters or update under the disabilities tab but it shows on va.gov also. I will let you know when i see the ebennies change for everything showing up.

VA.gov updates?
i don't know where else to put these questions since claims are no longer going through e-Bennies. i put in several new claims recently. one back in December. there hasn't been an update since i submitted and has been in the same status since it started: i had a 2 C&P;one a month ago and one last week and still no update!

Defense Bill Passage and Bladder Cancer

I already get compensation for bladder cancer for Camp Lejeune Water issue, now that it is added to Agent Orange does it mean that the VA should pay me the difference between Camp Lejeune and 1992 when I retired from the Marine Corps or do I have to re-apply for it for Agent Orange, or will the VA look at at current cases already receiving bladder cancer compensation. I’m considered 100% Disabled Permanently-

5,10, 20 Rule

The 5, 10, 20 year rules...
Five Year Rule) If you have had the same rating for five or more years, the VA cannot reduce your rating unless your condition has improved on a sustained basis. All the medical evidence, not just the reexamination report, must support the conclusion that your improvement is more than temporary.
Ten Year Rule) The 10 year rule is after 10 years, the service connection is protected from being dropped.
Twenty Year Rule) If your disability has been continuously rated at or above a certain rating level for 20 or more years, the VA cannot reduce your rating unless it finds the rating was based on fraud. This is a very high standard and it's unlikely the rating would get reduced.
If you are 100% for 20 years (Either 100% schedular or 100% TDIU - Total Disability based on Individual Unemployability or IU), you are automatically Permanent & Total (P&T). And, that after 20 years the total disability (100% or IU) is protected from reduction for the remainder of the person's life. "M-21-1-IX.ii.2.1.j. When a P&T Disability Exists"
At 55, P&T (Permanent & Total) or a few other reasons the VBA will not initiate a review. Here is the graphic below for that. However if the Veteran files a new compensation claim or files for an increase, then it is YOU that initiated to possible review.
NOTE: Until a percentage is in place for 10 years, the service connection can be removed. After that, the service connection is protected.

Example for 2020 using the same disability rating
1998 - Initially Service Connected @ 10%
RESULT: Service Connection Protected in 2008
RESULT: 10% Protected from reduction in 2018 (20 years)
2020 - Service Connection Increased @ 30%
RESULT: 30% is Protected from reduction in 2040 (20 years)-

While the BVA has some discretion here, often they "chop up claims". For example, BVA will order SERVICE CONNECTION, and leave it up to the VARO the disability percent and effective date.
I hate that its that way. The board should "render a decision", to include service connection, disability percentage AND effective date, so we dont have to appeal "each" of those issues over then next 15 years on a hamster wheel. -

Finally Won...NOW WHAT?

Finally heard back that I received my 100% Overall rating and a 100% PTSD rating Following my long appeal process!
My question is this, given the fact that my appeal was on the advanced docket and is an “Expedited” appeal, what happens now and how long(ish) is the process from here on out with retro and so forth? I’ve read a million things but nothing with an expedited appeal status.
Anyone deal with this situation before? My jump is from 50 to 100 over the course of 2 years if that helps some. I only am asking because as happy as I am, I would be much happier to pay some of these bills off!-

I told reviewer that I had a bad C&P, and that all I wanted was a fair shake, and she even said, that was what she was all ready viewed for herself. The first C&P don't even reflect my Treatment in the VA PTSD clinic. In my new C&P I was only asked about symptoms, seeing shit, rituals, nightmares, paying bills and about childhood, but didn't ask about details of it.
