I've been TDIU, since 2004, and last year, I knew my son was coming up near college time, so I pursued filing for an increase, and to ask for P&T. It's been a long haul, and I put it off for awhile, because, well, went through a divorce, and I helped some vets at a Vet center, and in the end, I remembered the stress of fighting with the VA, but I knew that I had to do this for my son. The state representative tried to persuade me not to push in case I got reduced. Told him I wasn't worried about it, as my health had gotten a lot worse. No attorney representation entitles me to 100% of retro award. Thanks for teaching me to fight and never quit. Now I'm waiting on my direct deposit retro for almost four years with the increase to SMC-S1 from 100%. I have a docket # for my appeal at the CAVC, but no more money for me is involved when my attorney wins that.

I just received approval of 5 disabilities I've been working on for over two years. 30 to 80%. Certainly couldn't have done it without the help, knowledge and support I've gotten from all the great folks on Hadit. But even though anxiety can get to you at various stages of the disability process, you just have to "keep at it." A denial is a road block, not the end of road. I am writing this because I have had great success using the Live Tele-Townhalls with Under Secretary Paul Lawrence. I can not say enough about him and his staff. I have listened to about 5 of them live of which 3 of them I peatipitced in. If you Press #3 and ask a question even if you do not get to talk to Dr. Lawrence live his staff will call you back and try to resolve your issues. And no I am not a VA Employee. I am really excited and surprised to learn that I finally reached my 100% P&T SMC from the VA. I just wanted to express my appreciation to this website reading about others success and not giving up. I was truthful with my disabilities to my C&P examiners and when I doubted my issues would not be looked at seriously I found that they were. I don't have the official letter yet, but I received my more retro deposited, and my hired gun says that what I got. I need to find out about the education payments retro for my daughter who got two MB's, and owes a lot $$$$$$. We always kept those forms filled out while she went to schools, so not sure when and how they will pay those, or the amount that the va pays for the disabled vets children's education. This is a little confusing because I have not gotten my rating decision. I was not even looking for this claim to be decided so quickly. I do not know what the Reasons and Bases will say. I filed a Sleep Apnea claim last month secondary and I had my LHI C & P exam last week and my claim is already completed, and rated service connected. It looks like my battle with the VA has finally come to an end. I never gave up fighting. I was recently granted service connection for Obstructive Sleep Apnea at 50% at the regional office level. This now puts me at a combined "90% Schedular with TDIU." That was the last claim that I had pending with the VA. The VA has also sent me several additional forms with my award letter that I was not expecting. These forms are as follows: 1. Just wanted to share this with everyone as I prefer to give credit where it is truly due: After I won my recent claim, with this forums help for my mental health my brother-in-law, an Air Force vet, began to look at his mental health more seriously. With guidance I received via these forums, I helped by advising him on how to develop his claim and he submitted everything on Jul 1 2020. Today, he received a lump sum deposit from VA. Forgive me for the late post, as I actually got this decision at the end of July 2020. It took two months for it to sink in to my thick head. I was increased to 80% combined disability. Here is the kicker: the VA also awarded TDIU along with that increase. Even more surprising is this: this was a “regional office adjudication” and not a BVA appeal. At this point, I have had three decisions (the initial 50% award, which was then CUE’d and increased to 60% by a second decision. A subsequent increase was filed again and about 10 months later was increased again to a combined 80% with TDIU.) All three of my decisions came from the regional office level and as of now, I …

I already get compensation for bladder cancer for Camp Lejeune Water issue, now that it is added to Agent Orange does it mean that the VA should pay me the difference between Camp Lejeune and 1992 when I retired from the Marine Corps or do I have to re-apply for it for Agent Orange, or will the VA look at at current cases already receiving bladder cancer compensation. The 5, 10, 20 year rules...
Five Year Rule) If you have had the same rating for five or more years, the VA cannot reduce your rating unless your condition has improved on a sustained basis. All the medical evidence, not just the reexamination report, must support the conclusion that your improvement is more than temporary.
Ten Year Rule) The 10 year rule is after 10 years, the service connection is protected from being dropped.
Twenty Year Rule) If your disability has been continuously rated at or above a certain rating level for 20 or more years, the VA cannot reduce your rating unless it finds the rating was based on fraud. This is a very high standard and it's unlikely the rating would get reduced.
If you are 100% for 20 years (Either 100% schedular or 100% TDIU - Total Disability based on Individual Unemployability or IU), you are automatically Permanent & Total (P&T). And, that after 20 years the total disability (100% or IU) is protected from reduction for the remainder of the person's life. "M-21-1-IX.ii.2.1.j. When a P&T Disability Exists"
At 55, P&T (Permanent & Total) or a few other reasons the VBA will not initiate a review. Here is the graphic below for that. However if the Veteran files a new compensation claim or files for an increase, then it is YOU that initiated to possible review.
NOTE: Until a percentage is in place for 10 years, the service connection can be removed. After that, the service connection is protected.

Example for 2020 using the same disability rating
1998 - Initially Service Connected @ 10%
RESULT: Service Connection Protected in 2008
RESULT: 10% Protected from reduction in 2018 (20 years)
2020 - Service Connection Increased @ 30%

While the BVA has some discretion here, often they "chop up claims". For example, BVA will order SERVICE CONNECTION, and leave it up to the VARO the disability percent and effective date.
I hate that its that way. The board should "render a decision", to include service connection, disability percentage AND effective date, so we dont have to appeal "each" of those issues over then next 15 years on a hamster wheel. -

Finally heard back that I received my 100% Overall rating and a 100% PTSD rating Following my long appeal process!
My question is this, given the fact that my appeal was on the advanced docket and is an “Expedited” appeal, what happens now and how long(ish) is the process from here on out with retro and so forth? I’ve read a million things but nothing with an expedited appeal status.
Anyone deal with this situation before? My jump is from 50 to 100 over the course of 2 years if that helps some. I only am asking because as happy as I am, I would be much happier to pay some of these bills off!- 13 replies

I told reviewer that I had a bad C&P, and that all I wanted was a fair shake, and she even said, that was what she was all ready viewed for herself. The first C&P don't even reflect my Treatment in the VA PTSD clinic. In my new C&P I was only asked about symptoms, seeing shit, rituals, nightmares, paying bills and about childhood, but didn't ask about details of it.
