I have attached my denied claim for migraines. I have many docs I can attach. I.e buddy letter from my mother ( fractured skull prior to military), and also squad leader that mentions bad landing on military jump service connection ( knocked out). Military entrance exam showing fractured skull. VA NEUROLOGIST stating service connection. Sick call slip headaches. There is more but post. But I’ll start with the ones attached. I don’t understand the reasoning for denial . They have rated me earlier with SSD. My question is this, I applied for disability of my cervical spine, I had fusion from C4 to C7. My application was denied about year last, Sept 2020. After a month or two I received a copy of c@p exam and found problems. I put in a notice of disagreement probably by early Nov 2020, and as of this date I have heard nothing. When I log on to VA.gov site shows nothing. Local VSO I contacted told me they have it, but no movement. I have faith the notice of disagreement will be denied( just a impression I have) and this will go to BVA. SO my question is this how long does it take to get any movement for this, I can not track it? Thanks for your input

My husband passed away 1-7-21 and the death certificate stated Idiopathic interstitial pneumonitis. He had been at a 100% rating for the past 6 years. However the rating was for Schizophrenia Paranoid type. His private doctor wrote a letter stating the pulmonary fibrosis happened in Vietnam. But the VA dr said no there are no service records showing that and declined the claim. I included in the claim that the treatment for pulmonary fibrosis are steroids and the medical records show they had to stop the treatment because he became so agitated on multiple occasions. i submitted the following for a higher level review to request an earlier effective date, but was denied. Any suggestions I’m service connected at 20% for my shoulder. I submitted a disagreement with the rating decision dated 12/16/2020 with the effective date of my service-connected shoulder rotator cuff that is currently 06/08/2020. The rating decision included my request under evidence (Correspondence, conducted December 8, 2020), which was my request for an effective date change to my original submission on or about Oct 2006. I had my degenerative disc disease and flat feet bilateral claims denied, submitted a higher level review and a duty to assist error was found. The letter said there was a favorable finding for both and that a qualifying event, injury had an onset during my service and my service record shows I had a profile for both but yet still no increase in my percentage. They couldn't find really any of my records from when I was in the Army or from my deployment to Iraq and said my records were minimal at best. How is it my fault that the Army lost my records! Hello Everyone, I have a question if someone out there is willing to help. I have been applying and moving through my disability claims with the VA for about a year now. I've been doing it by myself and have been able to get my primary tinnitus (10%) with secondary migraines (30%) both service connected. I also tried to connect my mental health issue as secondary to my tinnitus, but I know that it really is it's own issue and I'm pretty sure that is what's going to come back from the C&P exam I had. Good afternoon to everyone, I was denied for Cervial spine after I had gotten it fused together, so I sent in a Freedom of Information request for my C@P exam. on VA.Gov it shows when it was received back in Oct. in the being of December matter of fact December 7, it was closed and stated I will see the information in 7 to days. I have not received a thing as today, so I called the 1-800 the young lady said I see that too, that is closed, so where is the information she said nothing for her to do, and passed me off to another number which was educational benefits. Does anyone have any ideas what I should do next. Thank you, Ken

I was denied for scoliosis, lumbar spine but under "favorable findings" in my decision letter it says "you have been diagnosed with a disability". During my C&P exam the examiner told me "I cannot service connect you for scoliosis, you need to re-file your claim for lower back pain". It was at this moment I realized my VSO did not listen to what I was telling him to file. It was obvious he was not paying attention to me since my appointment was cutting into his lunch break... I have refiled for lower back pain but I will lose 15 months of back pay. Is there any way to appeal my decision for "lumbar spine scoliosis"... Any ideas or advise?

So I filed for disability about 3 months ago and just had my exam on Wednesday for back and stomach. I injured my lower back a few times while in but feel I never got proper treatment. After I got out I've injured my lower back continuously. I finally had an MRI done and they found a tumor. I had surgery and everything a year ago, the surgeon told me there is no guarantee this is what is causing you back pain. Been a year and half since surgery and still having problems.
