Rated for Burn pits
Just got rated for prostate cancer due to burn pits for a six month period of 100%. I am a gulf war veteran(2004-2005) diagnosed and treated for cancer in 2015 until present. I need help with the following statement ( Can someone explain the deferred part). "Service Connection for prostate cancer ( burn pits) is granted with an evaluation of 100 percent effective August 11, 2022. Deferred for entitlement to a higher evaluation." Cavet: My claim is still open and is in evidence gathering stage. I have received my retro also. No where on this decision letter does it mention presumptive or PACT ACT. Thanks for any input. Burn Pits Registry - Scheduled Evaluation at VA Medical Center
Good afternoon, about two years ago I placed my name on the burn pit registry. Yesterday I received a call from Gainesville VAMC, Environmental Hazard Program to schedule an evaluation appointment. This is not a physical and or in person evaluation. The PACT Act I see has moved things along, has anyone completed an evaluation, I am interested to know if this evaluation will have an impact on pending appeals/adjudication. I'm SC for a few Environmental Hazard conditions (Desert Storm, Saudi Arabia and Iraq) and have a few in appeal status. Thank you in advance for whatever you can share. first question to mods here and @Tbird: can we add a section for burn pit under the specialized cases? i posted in "gulf war" cuz i didn't know where else to put my question. please move this post/question to the appropriate spot if a desginated "burn pit" cant be created. thanks in advance. ok so i submitted a claim when i first got out back in 2008...below is the denial from the VA. if i reopen this claim based on the new law, will i be awarded SC back to 2008(along with back pay?)??? i have lots of medical records showing sinus issues to support SC but i don't even think i need that with the presumptive conditions related to burn pits added, right? https://ww…

PACT Act Presumptive Conditions and BVA Actions
Good afternoon all, in 2003 I put in a claim for what are now a few of the presumptive conditions under the PACT Act. NOD denied all but two, I received a SOC outlining the denied conditions, I submitted a form 9 and requested my appeal be sent to the Board for a decision. Now that the PACT Act is in effect, does anyone have any idea if the VA will adjudicate presumptive conditions in the queue that are awaiting a decision before the PACT Act went into law? Non-presumptive Asthma Rating
Hi All, I'm writing in hopes of gathering knowledge from the personal experiences of those who have successfully petitioned the VA for a service connected asthma rating. I'm an OEF/OIF veteran and due to my MOS I was frequently in close proximity to burn pits and all that good stuff, my major challenge is I am a four years outside the 10 year window for a presumptive rating and my active duty military records are silent on the matter. I haven't heard much as of late only that claimants are still active on claims, however, have not heard much since KBR's last denial with claiming innocence since operations were during non peace time? Motley Rice, who was the suit that I was a part of losses, the Supreme Court ruled against the claims.
