New Question- Cfr 3.307
In my denial they are using this statute "as the medical evidence fails to show a dx of etc within the time period specified under 38 cfr 3.307" Where is the statute that says if you didn't miss dx it would have been within the year. 2nd question---if I ask for an increase based on the 0 sc for cyst(scar) and say this is now dx as HS how do you combat the 1 yr dx thing. It said something to the effect of 10% rating or dx in 1 yr. I have a 0 and dx 32 yrs later. If anyone understands what I am saying help me, I am not sure myself what I am asking.

ptsd Question On C&ps
Hello all, briefly I just reeived a call from the VA Hosp on Long Island scheduling 2 C&Ps. Osne medical one mental health. I currently am 70% PTSD and 20 % DMII I put in a request for IU and now have these C&PS. Question is this normal procedure ? why medical ? any answers advice would be appreciated thanks

Your claims are already at the BVA? When you said: claims file at the BVA Jude dose that means that you know already his or her name? My case went to the board and then remanded to the AMC they haven't finished yet. If by any chance would i have the need to disagree with the AMC decision, then could I addressed my NOD straight to my case Jude? lu12

Va And Nprc Records
Cryptic note to Tbird...never mind I finally figgured it out!!! Thanks anyway! Question...when you file a claim with the VA and the VA sends for you SMRs and service records at the NPRC, does NPRC send all the originals to the VA, or just copies of those records? Seems to me with the VAs poor record of losing documents, one's entire military history could be wiped out, permanantly. It's a good thing they're giving the new troops their records so nothing is lost these days (unless you send it to the VA). jaz

Poa At Amc
Does anyone know how to contact the the DAV rep at the AMC? If the DAV is my POA I should be able to talk to them and discuss the results that they are looking at on my file, correct? I want to know that they are acting in my best interest. I have asked this question to my SO a month ago and he said I would know something before they would but that didn't sit well with me. Yesterday I find out that my SO has changed again (5th time) and he has yet to return my call, so I turn to the information hounds on Hadit for advice. How would you handle this situation? Men and women- this is something we have not discussed much in years here. Last night my SVR guest was highly regarded veteran's attorney Bob Walsh. He mentioned a case on the air that he has discussed with me- The veteran had a FTCA and 1151 issue- In all the time all that took he continued to pay Co payments for medications which untimately were for disabilities service connected under Sec 1151. With Bob Walsh as his attorney, they successfully got a refund of years of co pay of this veteran's medications -all directly related to his malpracticed conditions. I was checking my accounts and a payment was posted from "DFAS-CLEVELAND RETSPCL". Does anyone know what this might be. I am awaiting retro pay but this is no where close to the amount. I would like like to know prior to calling them Monday, I have searched online and cannot find anything.

hypertension Claims File At Bva Judge
