Rating Specialist Has Decided My Claim At Amc
Hi All, Well, the " Rating Specialist has made their decision on my claim at the AMC, September the 4th and it has been with the " Rating Supervisor" since September 15, waiting for her to sign the form. Is there anyway that I can get her to put her John Henry on it and give me an answer. I ask Lidel today and he said that the decision has definitely been made and that no papers have been mailed to me. Anyone know of anyone to call. Thanks, Josephine

tdiu Claim Advice
My Claim is 5 years 2 months old and counting, from Cleveland Regional Office. As many of you know, the VA is to: , “VA is ‘to fully and sympathetically develop the veteran’s claim to its optimum before deciding it on its merits.’â€ン Roberson, 251 F.3d at 1384 (quoting Hodge v. West, 155 F.3d 1356, 1362 (Fed. Cir. 1998)) However, The VARO in Cleveland instead choose to deny my Service Connection for hearing loss, then ignore my informal claim for Depression and TDIU. Upon my Successful appeal through the BVA I was awarded a "complete grant of benefit sought" 3 weeks later the Cleveland RO "implemented" the BVA decision as follows: …

Amc Rating Supervisor Wants Treatment Records From Dr. P
Hi to all, I spoke to Lidel again and this is the scoop. I have a letter coming pertaining to: The Rating Supervisor wants treatment records from my Board Certified Internist from the last few years. I shall assume not from 1979 to date, but from 2004 to date. This we will have to wait and see. An opinion has been made by the " Rating Specialist" and it was thought that my file was waiting for the signature of the Rating Supervisor, but at this time, she wants my last few years of treatment records from Dr. P, my Internist of 30 years. I had told them of my illnesses over the last years, but no one requested his records. I made an appointment with him for t…

Va Retro Award Program
I have a question. Did anyone on this board receive their VA Retro Award while their files were still at the BVA or Appeals Management center? If so, what did you have to do? I'm told by the RO that nothing can be done until my files are returned and they can't use the temp files. I've been trying to find a rule, directive or reg that pertains to this type of situation but nothig yet. If there is one and someone knows about it please let me know. I'm A little skiddish when I'm told this and they can perform other financial duties without the files. For example: I was divorced in June 2007. Sent copies to RO in June 2007. Received letter in Aug adjusting my pay …

Blue Water Haas
Just an update from NVLSP but a good reminder of the pending Nov 2007 court decision. The recent demolishment of the ridiculous S 2026 BWV bill is truly a victory for Blue Water AO vets- now they need one more victory- the big one- Haas -Nov 7, 2007 oral arguments and then the decision. "Summary of the Current Status (as of Oct 06 2007) The VA’s appeal of the Veteran Court’s Haas decision to the U.S. Court of Appeals for the Federal Circuit: the VA filed its initial brief in the Federal Circuit on March 7, 2007. You can view the VA’s brief, without its addendum (the Veterans Court’s Haas decision and judgment), by clicking here. NVLSP filed their brief on beha…

Can A Denied Condition Be Later Approved If Linked To An Service Connected Injury?
I guess what I am asking here is, once the VA deny a claim using evidence from that condition, can they use that same evidence to deny someone if they claim the previous injury as being secondary to an approved service-connected condition? Please don't beat me up with this but a claim for depression can be denied based on the evidence when linked to a personality disorder but could very well be established in a condition such as IBS if proven to be service-connected. Does this fall under reopening a claim if you filed for the condition previously as a primary condition or is it a new claim altogether thus disallowing the previous claim for depression to be a basis f…

lumbosacral Somewhat Confused
After coming to Hadit.com, I reviewed all of my claim information and then determined based on the SOC I received in 09/05 to file a new claim. I initially refiled a claim for a rate increase in 05/2003 (which is pending an appeal) for my SC low back disorder (described as "chronic" lumbosacral strain, awarded 01/17/1979). The first time I filed for an increase was in 02/1979. The claim was closed when I failed to appear for a personal hearing in December 1980. Okay, moving forward. I re-enlisted into the Army with the above SC from the AF indicated on my enlistment exam. Condition worsened while in the Army. Filed another claim for increase in 1984 (no record …
