hypertension What Is The Best Approach For Claim?
While on active duty in the late 80's, I had 2 injuries, one a back injury with severe muscle spasms in which the doctor precribed 5 days of bed rest. This problem was flared up several times while on active duty. I haven't seen my SMR since the 80's so I really don't know what's in them! Also, I fractured my right ankle but it was treated as a sprain and for 8 months I walked and ran(including 2 PT runs) around with pain until it was discovered and properly treated with a leg cast for several weeks. I started having severe pain in my knees just before getting out of the service and noted it in my exist physical exam along with my back. Two months after getting out of the…

tdiu Total Disability Rating Based On Iu
I found this on VA Watchdog...I found it very informative and hopes it can help others...it did me. MT "Training Letter 07-01 Total Disability Ratings Based on Individual Unemployability (IU) Benefits granted under the VA rating schedule are intended to compensate veterans for the average impairment in earning capacity that results from service-connected disease or injury. IU is a special additional benefit to address the truly unique disability picture of a veteran who is unemployable due to service-connected disability, but for whom the application of the rating schedule does not fully reflect the veteran’s level of impairment. An award of IU allows the…

Anyone Ever Heard Of This
When I got out of the service at my muster pysical I flunked the whisper test and they wanted to keep me a couple more days so they could run some test OR I could sign a waiver (not sure what it said) but I signed it cause I was 22 years old and just wanted to go home. Anyhow my hearing really started going south and in 83 I filed a claim at the VA just looking to get some help of some kind aid or something. Well the VA denied the claim in one line saying hearing is not service connected. I am service connected now at 70% and get my aids and all from the VA BUT I am still not service connected, should I even try to see if they will look at this again? Stillhere

Thalamus
Bob this is my new post. I have a appeal pending for loss of use. Actually they did not decide against my claim they simply blew off the effects of my stroke. By this I mean they simply awarded me a 10 percent rating in Jan 05 and failed to rate the residuals. The residuals of the stroke are called Dejerine - Roussy syndrome. Yes you will find info on Painonline - they term it centeral pain syndrome. One of the best references is at :http://www.centralpain.org/ Believe me good buddy I have read and read and re-read both sites late at night because I could not sleep due to the pain. Doc currently has me on 4000 mg of neurontin, 1600 mg of Trileptal, 180 mg of c…

For Kent
Kent, You posted, " The military discovered the MH problem while on active duty and after a brief hospitalization and a diagnosis of depression and a personality disorder, she was allowed to complete her enlistment. " A Personality Disorder will only be service connected if it is the result of something like a documented head injury and the Personality Disorder has been superimposed. I feel VA will say her depression is a result of her Personality Disorder. I do not see this claim ever getting granted as service connected, but certainly do wish you luck. jmho, carlie

diabetes Mariano
This decision bears repeating here as many veterans find the VA has ignored their probative medical evidence, specifically to include IMOs. Basic VA case law-reiterated in Mariano states: “The Secretary shall consider all information and lay and medical evidence of record in a case before the Secretary with respect to benefits under laws administered by the Secretary. When there is an approximate balance of positive and negative evidence regarding any issue material to the determination of a matter, the Secretary shall give the benefit of the doubt to the claimant.” 38 U.S.C.A. § 5107. also : 38 U.S.C. § 5107( (when there is approximate balance of …
