ptsd Ptsd
I saw a "contract" Psychiatrist at VAMC C&P hearing for a non-combat PTSD Claim. He denied service connection but conceded my PTSD. I was a Navy Hospital Corpsman attached to the 3rd MARDIV during Vietnam and was an Emergency Medical Technician at USMC Base, Camp Pendleton, after rotating home, for a period of about two years. VA has accepted my stressors but has denied my claim. I just received notification for a DRO hearing on September, 12, 2007. I have a representative from American Legion who is helping me and will accompany me to hearings. I have four private Doctor opinions and one VA Staff Psychiatrist opinion which support my claim, and I attend VA grou…

tdiu Dro
I got a VCAA letter today and a letter asking me if I wanted a DRO for my appeal for a much earlier effective date for my TDIU. I filled out the paper work and hand carried it to my RO. I got date stamped copies. When I do this I always get action much quicker than when I just mail it in. Even when I send it certified my documents seem to go into lala land for a few extra months. I drove 25 miles to the RO which is so close it costs about the same as sending stuff certified. I sleep better knowing I have a copy of my paperwork. The VA puts it into the computer on the spot. I recommmend taking you stuff and putting it in their hands if possible. You can save yourself month…

Claims File Transferred?
I just got off the phone with the AMC and the VA 800 number status lines and they both are telling me that my claims file has been temporarily transferred to the West Los Angeles Medical Facility. This is the same facility where I had my C&P exam in Oct 2006. Anybody know why my claims file would be transferred to this medical facility? Has this happened to others? Happy Trails Paul

ptsd Cue Regs In Action
http://www.va.gov/vetapp07/files1/0706616.txt "The crux of this case is that the claim was denied in June 1987 because according to the RO the veteran did not indicate any "specific" stressors, and accordingly "specific" stressors could not be verified. The RO acknowledged receipt of the April 1987 letter from the US Army and Joint Services Environmental Group, which informed the RO that the veteran had been awarded the Army Commendation Medal for his actions in Nicaragua after the December 1972 Managua Earthquake. The attached citation noted that the Managua Earthquake had resulted in "massive numbers of casualties"; that "[o]nce arrived at the …

tdiu Tdiu Cue
Most CUEs at the BVA fail-but some certainly do succeed. "ORDER The motion for reversal and revision of the July 8, 1981, decision of the Board which denied the veteran' TDIU benefits is granted. " from : http://www.va.gov/vetapp07/files1/0708830.txt In 1979 the vet, in receipt of TDIU, received a letter that terminated his TDIU. I dont know why he waited so long to challenge that with a CUE but in this 2007 decision- the BVA found obvious clear and unmistakable error in the termination. FINDINGS OF FACT 1. By decision of the Board in July 1981, the Board upheld the termination of a TDIU rating. 2. The July 1981 Board decision failed to…
