Anyone Have This Happened?
I have been searching the hadit.com archives to find an answer to my question but can't seem to find anything that relates specifically. Question is: "Have anyone of you experienced having a claim on appeal for sc condition; but file a new claim on why the RO said your sc claim was denied rate increase? If so, did the RO start working the new claim and then "invite" you to address the claim on appeal, as well? I have new claim being worked for the condition and IU that is based on VAMC current diagnosis. My claim on appeal was initiated back in 1983 for an increase but got denied based on the fact that my current diagnosis indicated that was the reason for my chr…

Veteran Has Total Rating At 180%, But Rated At 100% T&p With Smc
Greetings, I have been working with another veteran who has a total rating of 180% with SMC. He is paid at the 100% rate. He is not IU!!!!!!!!!!!!. He has been offered a job to work at home using his computer. The question I have is this. He told me that our RO informed him that because he was NOT IU! that he could make as much money as he wanted because his rating is not based upon IU! I see this issue both ways. I would not give the VA any ammo to use against me, and what would stop him from making money since his rating is not IU? I like him am rated at 220% but also paid at the 100% level. I was IU for about 2 years and during those 2 years I always rec…

Hello All
Good evening everyone. This is my 1st time posting on this site and I wanted to thank everyone here for helping me with my disability claims. I never posted on here but gained a lot of knowledge from everyones personal experiences. I am an OIF Veteran rated at 90% schedular and paid 100% IU. I would like the form # for filing for an increase due to more pain from my headaches. I am currently rated 30% which I feel should be 50% because most of my week is spent laying in our spare bedroom away from light or sound. I would also like to apply for permanent and total but do not know the form #. If someone can give me these form numbers I would greatly appreciate it. Thank you…

lumbosacral Va Is Trying To Hoodwink Me
Hi there I probably have one of the most complex case(well VA made it complex)ever. At the rip age of 14 I went to an doctors appointment to try to figure out why my legs was hurting, the doctor said that I was having pain in my back or that where i was getting the pain from, I told him that my back didnt hurt at all(which is documented in that report) just my legs. Instead the doctor did x rays on my back(which the films are not available and the doctor is decease as of this date) revealing that I had bilateral spondylolysis at the L5 and minimal Grade I anterior spondylolisthesis L5 S1 no acute injury or other abnormalities are recognized. I was give Mortin 800 and sent…

To support a potential claim for CRSC, I electronically requested a copy of my DA Form 2-1 which shows Army assignments, schools attended, awards, etc. I sent the Internet request to the National Personnel Records Center on September 5th. I received the copies in the mail September 17th. Pretty efficient...

hypertension Imo Should I Submit Now Or Wait
I had a doctor come thru and write an IMO for me, I think it will be a great peice of evidence to get the VARO off the dime and grant the claim in my favor, this doctor can NOT be dismissed as an intern that does not know what they are talking about. your opinions I am putting in the summary and conclusions. SUMMARY AND RECOMMENDATIONS In my opinion Michael Bailey's hypertension and early onset of arteriosclerotic heart disease is more likely than not caused, or at least severely aggravated, by his service- connected PTSD. The VA center where Michael obtains care does not let individual doctors diagnose PTSD. It was done by a team of three clinicians who in…

Accrued Benefits
If a veteran has evidence in their c file at time of death of potential award of any type of accrued benefits the VA often awards any SC comp due the vet but fails to consider SMC that could be due the veteran. I had to prepare a bit of info for VARO as there has again been movement on my claims- my recent VCAA response (first VCAA letter I ever got in full compliance with the VCAA- I was successful in responding to in a way that drew out all of the evidence I sent them that they have never addressed. A VA rep confirmed for me today what I always feared- if the VA does not send an election form under the VCAA, the VA never gets a signed election form back and this …
