lumbosacral Nod For Back Disability
Hello everyone, I need a bit of assistance with an issue. Here is a bit of a back story to my issue...3 years prior to entering the military, I was injured in a car accident during which I sustained an injury to my back and neck. After several months of physical therapy I was released by my doctor who provided documentation to support the fact that my condition is now asymtomatic. Here it is again- I found it in seconds using our search feature: An Independent Medical Opinion from a private doctor should contain certain elements: 1. The doctor must state that he or she has reviewed the SMRs (if needed)they arent needed if presumptive disability-and all available clinical records- and in my case and sometimes others- other VA documents pertinent to the claim. The doctor needs to have a background and expertise consistent with the claimed disability. 2. The doctor should provide a statement as to this expertise. Unrebutted Medical Evidence
In responding to the VCAA letter I recently received I used citations of VA case law to make sure they handle it right. Mariano V Principi which I cited- I mentioned here once before but believe it is worth repeating what this case is all about again. If you have sent the VARO IMOs that are unrebutted by any so called VA expert- those opinions stand as probative medical evidence that prevent the VA from trying to find some other VA quack to knock down. I have 3 unrebutted IMOs. A socalled VA expert had the chance to rebutt two of them and didnt. One of my friends had hypertension diagnosed and treated while in service, and was treated after discharge, with some lapses in treatment because he couldn't afford the medical care and medication. He can't prove he had treatment within a year after discharge, or for several years following because the doctor died who treated him and the records are missing. He does have proof of ongoing treatment for the past 30 years. He has taken large doses of medications to control it and has had major complications related to it: CAD, blood clots (pulmonary embolism, DVT, and intestinal), heart attack, and renal failure. I am sorry -I dont have the time to answer claims questions off the board- The sole reason I had to open my PM thing here today is to straighten out an issue with a member who received the 2007 Edition of the VBM recently but I got their bill. I am only interested in the response from that member to my PM to them this AM. Someone posted a claims question as soon as I opened the PM thing and I hope they will post it here in the public forum. I simply dont have time for PMs involving claims issues etc and want to resolve this VBM matter regarding this bill I got- as soon as possible.

tdiu Va Billed My Wife's Insurance
I have been 100% TDIU P&T since 2001. I use private medical care outside of the VA but I have to go to the VA for a checkup twice a year. The last time I went they asked me if I had private medical insurance. I told that I am 100% P&T and did not give them any insurance information. My wife's insurance takes good care of me and I do not believe the VA has a right to bill them. Lo and behold yesterday I got a copy from my wife's insurance that the VA billed them for my semi annual visit. I just got "reevaluated". Clear And Unmistakable Error (cue) Question
In cases where medical evidence in the c-file was apparently overlooked or disregarded (with regard to a rating that would have been higher if taken into consideration) grounds for Clear and Unmistakable Error (CUE) action? I am confused about the grounds for CUE--must the evidence be new/previously not submitted?

tinnitus Hyperuricemia, Gout
I have hyperuricemia and gout. I had high uric acid level on march of 1990 while in the service. My shoulder consistently bothered me but they could not find or figure out why. After getting out in january of 1993, I went to the VA at FT Lyons Colorado and they diagnosed me with gout and hyperuricemia. I have had gout attacks and high uric acid levels throughout the years. Last year I did not go to the doctors even though I had two to three attacks cause at one point the VA put me on allupurinol and that made things worse. I had a gouty tophi removed from my knee in the summer of 2004. I have been to the drs twice this year for attacks. I filed a claim in March. …

Blue Water Veterans To Be Rejected
Akaka, seems to be a puppet of Larry Craig's or maybe they are both on the same strings. We had hopes that Akaka would be sympathetic to Blue-Water Veterans after Veterans 30+ years of research and suffering. This legislation is not just against Blue-Water Vets, although it has the appearance of such. It appears that Senator Akaka, under the shadows of the Ferres Doctrine, would disallow Veterans compensation for suffering caused by Chemical Companies who greatly profited from their Senate bought puppets.
