Blue Water Vet Succeeds At Bva Under
Haas was law of the land for a limited period of time.Advocates were urged to network all vet orgs to make sure Blue Water veterans had filed claims in this time frame- as they had to be adjudicated under Haas. Haas also was to cover- as law- even though a temporary law- all pending claims. This claim is a GREAT example of how that is supposed to work: http://www.va.gov/vetapp07/files2/0714786.txt Blue Water vet in receipt of the VSM-no 'boots on Nam' ground- service connected granted July 2007- due to Agent Orange exposure. The decision in part states: "The central issue to this claim is whether or not the conditions of the veteran's service consti…

Viewing Your Claims File
Can you request to come in and view your claims file? I tried through the 800# and was told you have to send in a request for a copy and they'll send you a copy, but you can't come in and view it anymore. Has anyone else run into this?

My Appeal Is At Pre-determination
I asked my SO the status of my reconsideration and was told it was in Pre-Determination, First stage. SO said there are three steps in this determination phase. Has anyone heard of that befor? I also submitted my reconsideration in late Aug and now it is early Sept...sounds like it is moving ahead fairly fast. I did get a standard VA letter stating that they have my claim and they will contact me if they need any additional evidence and ofcourse the letter said they are dealing with a large backlog of claims....

2007 Vbm In Mail To Advocates
The new VBM just arrived- I am too busy to look it over but opened to a statement that I think is overlooked by many veterans. Page 372- Special Monthly Compensation due To CUE. As you all know I have CUE claims filed on SMC-lack pf consideration in 2 final VA decisions. NVLSP explains it better than I think I did here- They cite Marlowe V Brown in which the veteran -at time of a 1948 BVA decision, could not speak nor read and also had epiletic convulsions- all service connected---- as well as complete SC paralysis of right side. The veteran in the 1948 decision was awarded SMC "M"- a high level of SMC. However in 1989 the vet questioned this fin…

Trojan Virus
I usually click in directly from AOL and dont get the home page- I go directly to the forums- But I used IE to show someone the Homepage and immediately- as soon as the Microsoft ticker came up which I didnt click on- my Security Program warned me of the Trojan virus which I immediately deleted and scanned my 115,000 files right away-even though my security program was set to do that an hour later (I scan for security problems every day). I did not associate this with hadit until it happened again today- the name MauriceHurst also pops up as a www site on my PC same time as the microsoft ticker- on the Home page- and then in less than a second the Trojan Virus …

this afternoon I lost conciousness and my brain lost function for a matter of time, I lost all control of bodily functions (at least I didn't get yelled at like the cat does) my wife called 911 and had me taken to the nearest hospital I was discharged about 2200 hours and told to go see my primary care doc at the VA tomorrow, the doctor said my blood pressure had bottomed out probably due to medication it was something like 55/40 and the cat scan and lab work didn't show anything, no heart attack that was what my wife thought. Who do I call at the VA about the bill since I am a 100% P&T and they are my only healthcare provider? Help I an going to hate to see…

Berta
Berta, Here I am again with more questions. I saw below where the VA may pay for emergency room visits at civilian hospitals. OK....I'm on SS & 100% t & p for the same thing. Epilepsy & this is the only time I go to the civilian hospitals This has been going on for some years & I see that I may be able to get reimbursed for what I have paid. If I could I'd have the Ambulance take me to the VA but they have to go to nearest hospital to get me stabilized. If I can get reimbursed how many years can I go back? Again, Thank U very much for taking your time to help me with all the questions I have GARY

After Action Report--received Rating 4 Sep 07
1. What I did wrong: Did not educate myself regarding the applicable guidelines, laws, and regulations that the VA would use in evaluating my claim. Did not reply in a timely manner to requests for information from the VA. Did not (initially) seek expertise of American Legion or other service organization AND Hadit.com. Did not idiot-proof my documentation for submittal to VA. 2, What I did right: Did follow-up telephonically with various physicans from whom I requested supporting medical evidence, even though the VA was requesting the information on my behalf. This procedure involved three different cities and approximately eight…
