This is email from Ray B. Davis- well known vets advocate- I am not commenting at all on Ray's letter to the Pres- it is just part of the email copy-and no reason to start some political ranting at all here- I sure didnt see this idea in the Dole Shalala report- SSA is earned by work credits for retirement-to include military service- and VA comp is due to SC sacrifice- I cannot imagine why this is even an issue but appraently it is now--- Then again I have not checked this info out-and believe Philpott-not that Ray would put anything untrue on his site- it is just absolutely bizarre to me that anyone would even attempt to pull something like this: (actual…

hypertension Need A Link
Does anyone know of links, (previous cases) where the vet is connected for Major Depressive Disorder and linked to hypertension, back and neck problems or something like that?

hypertension Effective Date;
Lets say a veteran files several claims in 1994. One was for Hypertension. He was scheduled for a C@P exam without service records. ( Were not found until 1998) At the Exam the Veteran was diagnosed with Hypertension. The record show several high blood pressure readings in service with compensable levels yet the claim was denied for lack of records. Also denied a reopen in 2000 stating service records were negative for any mention of hypertension. What would the effective date be: Where is the CUE in this? Reopen was successful in 2003 with that being the award date.

"date Of Receipt" And Evidence/vaforms
Greetings to All I have a question/concern regarding evidence/forms and "date of receipt" at the VARO. My statement of case was dated 20 Oct 05. It gave me 60 days to file my appeal. With the sixty day rule to respond, wouldn't my response date be not later than 20 Dec 05. The VA is saying that my Appeal/Form 9 did not get to my folder until 30 DEC 05. Note: I have my USPS express mail receipt showing the Form 9 was receipted and signed for in the VARO mail room on 16 Dec 05 at 1010 AM. What does the VA regs say about "date of receipt" of mail. Is it the day it gets to the mail room or the day it gets to your C file.?? Will …

Does this (from a 1978 C&P) qualify as an informal claim for Tinnitus ? I think it does but have been beaten down so much I question my-self. ptsd Malpractice And Medical Negligence
This happen in 1985, My Nephew was on ship when he was raped by two men. He reported it and it was written down. They kept him on ship with these two guys nothing was done to them and my Nephew had started drinking and haveing a lot of problems. It is to long of a story to write down I have his files and its to much. All of this finally came out by his doctor in the last year. Question is: Can we get a lawyer and go after the Military for all of his medical problems and for what had happen to him aboard ship. They kept these three together till he was discharged. Knee Degenerative Issue
Discharged in 1995 with 10% left knee chronic pain. XRAY showed mild sclerosis with a diagnosis of mild degenerative disease. I just had another XRAY and my doctor stated the report showed mild arthritis. The range at the original rating was 0 to 135 degrees. I am considering asking for a rate increase on my left knee due to increased pain. Is there any advice members could give on getting an increase. Detonator

Nsc Pension/sc Disability?

Now, I filed "nsc claim" on june 25th,07 [disabilities..chronic depression[lifelong] & since leaving the service[soc.Sec.earnings Statement] shows 4yrs. out of 32yrs. where i earned "above Poverty level", worse past 7-10 years,admitted 2x in 30 days recently, in VA psyc. ward..bilateral knees,,chronic low back pain,,broken right scapula[shoulder blade,recent car accident]...1st-"depression" now being treated by psyc. and 100mg. Imos Suitable For Rating Purposes...clinician's Guide
I talked with Ron Abrams recently and he said something that stayed in my mind because of the discussions here about how to get the VA to accept IMOs. Too many veterans have had them rejected or discounted, so maybe this will help in an appeal. Ron says that the IMOs must match (as close as possible) the VA's Clinician's Guide to ensure suitability for rating purposes. I looked at the guide again and realized that it also could help in organizing a claim. Here's a link to the one I've found online. diabetes I Am Really At A Loss Here....
I got my letter from the VA on Friday. This was my appeal. I applied for disability related to PTSD in 2006. When I tried to do the initial stressor statements, I just couldn't do them. They denied it because I never submitted anything. Ok... so I appealed, submitted copies of my treatment record from my private shrink for the last several years. I did the stressor letter, researching dates, names, etc. It wasn't hard to find the names and dates on the wall. It was however, very hard to sit down and write it all down.
