Sleep Apnea And Insomia
If a vet is diagnosed with insomia and sleep apnea and the exam provides that both are at least likely as not due to his service is the insomia a part of the award for sleep apnea or should each receive its own rating? If so what are the rating codes for each? Thanks

Smc-s Again
I posted about this before but after talking to my DAV agent I just want to make sure I understand the dam CFR. I am getting a temp 100% for hip replacement and also have about 75% in other disabilities none of them are for blindness or loss of food or anything else. The way I read the CFR anyone with 100% and other disabilities totaling 60% or more automaticlly qualifies for SMC-S. I argued with the DAV for 15 minutes and she still said I have to be blind or missing a foot leg or something else. She sounded like she new what she was talking about. Now I wonder if I got it wrong or misunderstood the answers I got from this website. Sorry but I can not think too well s…

A Question On Benifits For A Spouse Of A Veteran
I had a fellow Veteran tell me that he read an article from a benifits summary article in the AF Times. Basically, it mentiones that if a Veterans spouse becomes disabled for mental and or physical health that there is some sort of VA benifits. I told him that I have never heard of this, but would post the question on the forum. Anyone know? He mentioned that there was no mentioned about the spouse working or not, so I don't know if that would be an Issue.

Seeking Any Help And Advice
Hello, I have read quite a bit of info on here but am lost as to what I need to do for myself. I am SC 10% for osteoarthritis in left knee. I started having back pain in Nov. 06 and finally had MRI which showed facet arthritis, bulging disc, and foraminal narrowing all on left side at L5-S1. I go for my last visit of PT tomorrow, which hasn't helped and meds haven't helped. I am self employed and do construction work, remodel, decks, hardwood floors, tile work, etc.. I haven't worked the last couple of month's due to my back and the Physical Therapist said I shouldn't be doing the type of work I do. So, I am really lost as to what I should do. Who do I go see to…

Hearing Loss Claim And #s To Support It
This is also posted in the Military.com forum Was wondering if somebody here would be kind enough to assist me. I was in the military 70-72. My AFSC was 6055X as I was a “dangerous cargo specialist.” My job was to get high priority cargo on/off the plane. Most had to be signed for so I was required to meet the plane sign and get the cargo then get it to the plane have the cargo signed for and released. A lot of it was human remains returning from Nam and such that required me to be there when the plane pulled in. Also, I worked in the air freight terminal which was located right next to the passenger terminal at Yokota AB which was probably the busiest airport in its…

diabetes Va Letter Calls My Nod
My AO death claim has been pending at the VA since Feb 2003- Since the fast remand last year they have consistently told me thay are working on it and my CUE for SMC-which was denied -but I filed a reconsideration request on it. I filed a NOD on the SMC CUE to make sure my NOD appeal period didnt run out-on June 21.2007 This letter says they received my CLAIM for SC due to heart disease secondary to Rod's PTSD on June 22, 2007! What claim- I had an old claim at the BVA on that- I never appealed it because I got SIC under Sec 1151 in 1998. In AUgust 2006 the VA filed a Motion to Reconsider that old BVA claim. But they didnt tell the BVA what the decision da…

Service Records
I contacted the VA this week to check on the status of my claim. I was told "We have requested your complete service medical records from the National Personnel Records Center. Once we received your service medical records you will be scheduled for an examination, which you will be notified by the VA medical center as to when and where to report for the exam." Just wondering if anyone knows what will happen if my service medical records are not available to be sent? Thanks

Constructive Possession
On Saturday AMs- as time allows-I continue to search my POA's cases at the BVA (in case I have to make formal complaint to the GC regardng their high remand situation due to VCAA violations-I already have an extensive list) In three very recent cases I found this AM- where the vet had the same POA I have- the BVA actually had to do a remand of a past remand! I didnt search for more yet-double remands- this is unconscionable- In one case the BVA on May 8, 2007 ,stated that they had vacated their past decision of Dec 27,2006 because they became aware of "additional evidence not in the claims file-but in the Board's constructive possession, when the board issued that d…
