The Invisible Walking Wounded
I have been teaching college classes since 1993. In that time, thanks to the GI Bill, and the fact that one of the schools where I teach is a community college near nd Air Force Base, I have had the opportunity to have quite a few active duty military and vets in my classes. The change that has occured the last couple of years is that some of the vets are now coming to class in wheelchairs.Young guys who went in the service walking and came out with no use of their legs. But I also realize that these vets - who most people typically think of when they think of "disabled vets" are but a small portion of the wounded - and that many of the vets walking into my classroo…

Sending New Evidence To Bva..berta....
Berta, Since U have always given me good advice I need more. ha OK....Here's the deal. I have a BVA claim in & they are working on June '95 & say thay got my claim in JAN. 96' I have a Doc's opinion ( In writing) that I think will cinch this one. My problem is can I send new evidence to the BVA on an active case? Cause if they deny me & I file a NOD with this opinion I doubt if I'll be around to see an end to it the way the VA drags their heels. Any advice, as always , greatly appreciated. Also, if I may, what's up with the Comp ending when one is 65 years old? Guess the VA will offer to cremate U , free of charge, at 65 if they…

tdiu Appeals Management Center
Hello all, Last time I was on here. The BVA had ruled on 1 out of 4 issues that was before the BVA in Washington, DC. the Judge ruled for an increase from 40% to 60% form my Back injury back to Aug 1993. The dicision was dated march 8, 2007. Well...I havent recieved the back pay from that ruling as of today. "keep this in mind" I although I already 100% IU P&T effective June 2004. I appealed that decision because I actually put in for IU in Aug of 1993....so I appealed the for an (EED), (eailier effective date)prior to June 2004. Ok, I'm thinking maybe they are going to decide the whole issue with the IU and just back the 100% TDIU back to 1993 and pay w…

Dro Hearing Today
1230 TODAY. My last chance to get some stupid things fixed b4 it goes to the BVA. Been working on my brief, script, or what ever you want to call it for a week and I am fried. Actually its a 14 page typed statement in support of claim with about 20 pages of new evidence attached. I plan to read the statement in support of claim as my presentation, and then hand it to the DRO when I am done. I am putting allot of hope into this Office of General Counsel Precedent Opinion Department of Veterans Affairs, Office of General Counsel Precedent Opinions 15-95 VAOPGCPREC 15-95, VET. AFF. OP. GEN. COUNS. PREC. 15-95, 1995 Applicability of the Final Stipulation …

Just Got Imo
The friend that I have been helping just got his IMO report. It was awesome! NOT only did it state that his injuries were more likely than not caused by combat , but the report also pointed out many instances of negligence and substandard care by the VA. Everything was documented in the records, and explained in plain English what exactly occured. "Whether through carelessness, neglect, arrogance or plain stupidity,Mr.----- nearly died before they "righted the ship". "I want to make clear that this damage was avoidable and inexcusable. The four years that this damage was allowed to continue is one of the most egregious examples of neglect that I have ever seen." W…

tdiu Tdiu Vs. Ui At 70%
I read in one of Berta response to another topic..."If the disabilities begin to add up to 70% SC the VA will consider TDIU" So what if someone has one condition that is rated at 70% alone. And the Veteran is receiving the 100% rate of compensation based on UI (unemployability). Could that Veteran then apply for TDIU for P/T?? I am confused on this part and I have been reading posts trying to figure it out. my way of thinking is if a VEteran is rated at 70% (first time around) and then receives at the same time rate of compensation at 100% based on UI, isn't the VA conceding that the Veteran in unable to work? And if that said Veteran has not been able to work any …

Va Won't Define Claims Affected By Haas
I am an AF MSgt (Ret) with DM-II, neuropathy, nephropaty, etc. I filed an AO claim on December 25, 2006, claim of transit through Vietnam (sworn statement). Recently, having asked Sen. John Cornyn to assist, he received a reply that the VA General Counsel was trying to decide what claims had been affected by Haas (from April 13, 2007 stay). This seems odd. Additionally, they have done nothing to comply with the VCAA of 2000, not looking for military retiree records which are pertinent. Does anyone have anything to suggest? I sure would like to file suit but don't have the resources.

Va Psych Exam
Hello, After reading this site for awhile, I thought that maybe someone could help me understand something. Below I put what was on my MEB by my doctor while I was active duty. The ARMY retired me medically at 50% for an axis I mental disorder of Delusional Disorder. I had the DAV at Ft. Carson help me with my VA claim, and all went well and rather rapidly. I filed on 13 July, and got my exam date on 20 August. I went to The Denver clinic about a week ago and talked to the doctor there. He kept trying to tell me that my real problem is that I am bipolar. I kind of disagree with that. I have read on here of some strange things happening like that, so maybe someon…
