More On Writs Of Mandamus
When is the appeals process truly "exhausted" and qualifies for a writ of mandamus? We had two claims at the VARO, denied, NOD issued, went to the Board in 2003, Board decided to remand in August 2005, remand went to the AMC, and there it still sits today. Judging from what Berta and Pete said in a previous post, I'm confused as to whether the AMC has carte blanche privilege to hold on to this remand as long as it likes, or if we can consider the process "exhausted" after 24 months and threaten to ask the Court for a writ of mandamus without causing ourselves more harm than good. Any opinions? Time to do something or just sit still and wait for awhile longer?

Achilles Tendon
I have a ? about the Achilles tendon, is the Achilles tendon for rating purposes, a part of the ankle, foot or the leg? I need to know for a secondary clam where the bone spurs on my heels rub on my Achilles tendon causing a lot of pain and makes it hard to walk at times, on my right and left heels. I am service contected on both ankles at this time. Also if any one can tell me about a secondary clam on IBS for the medication I take for a service connected back problem, the medication causes the IBS. Thanks Ken

Dependent.
hello everyone, its been a while since i posted anything, so here goes.in regards to dependents, i know that i can claim 1 or both of MY parents if they live with me as i am over 30%, BUT the big question is,when my father inlaw has to move in with me and my wife, (as he is not a disabled vet, but he is disabled to the point where he cant secure any gainful employment,) can i claim hime through the V.A. as a dependent? he's been waiting forever for social security, but no word yet. (i have been paying all of his rent, utilities, etc.. for several months)i cant afford to keep doing this...Martin

Statements Made By Veteran
I remember reading once where if a veteran made a statement that was detrimental to the claim - that such a statement could not be used in adjudicating the claim - that the claim had to be adjudicated as if the veteran had not made the statement. In essence, that would mean that a veteran could not "testify" against themselves. It should also mean the RO / BVA can't use any of the veteran's statements "against" them in denying a claim. I would also think this would apply to contradictory statements - that they couldn't use the rationale I have seen them use where they say the vet reported one thing at one time, and then stated something that contradicts that. The Korean War Project has updated its site and has started many data bases that can help Korean War veterans -not only with claims such as AO claims but also help to provide something for their families to make sure that this "forgotten" war will NEVER be forgotten.
