tdiu Remand Of Claim To Appeals Mgmt Ctr
I have asked questions before and received great advice. My question now is what do I do? The letter states" we are writing to let you know that the AMC will be developing additional evidence concerning your appeal, recently remanded by the BVA. The AMC, rather than your local RO will be developing your appeal." Remand is for 1--whether there was a CUE in a January 1978 rating decision which reduced the veteran's service connected colon condition to noncompensably disabling, 2--entitlement to an effective date earlier than January 31, 2005 for the grant of TDIU, 3--entitlement to an increased disability rating for service-connected irritable bowel syndrome with…

Temporary 100% Extend Past 1 Year
Hi, I have been searching many forums and also all of the Veteran Affairs regulations. I am unable to get a answer, so i am hoping someone else might have ran accross the same issue. Now they ahve stopped my temporary 100% and I am totally messed up from the surgery and unable to perform any work. The doctors have written many letters stating I do not need to be working period, until they can get me repaired. The question is, how do i get the VA to pay for longer than 1 year for convelesance? I hav…

One of them is IU, Hepitatis B & C, Osteopenia, and the other three are for allergies sinus and a higher rating for his chronic uticaria which he is currently 10%.The medical records now and then prove SC. Can anyone tell us if defferred means we have to fight for this? HE is 40 some years old does not work, lives on his 10%,VA Doctor states he is unable to work due to his medical p…

ptsd 100% Sc And 1151 Compensation
I am rated @100% disabled for PTSD. I was in Wisconsin VAMC and for two years was sexually harrased by a female staff member. I finally, after two years was able to get her in a circumstance that she could not get out of and reported her. There was a huge VA investigtion and ultimatly she was terminated as a result of her behaivors. I filed an 1151 claim and have been denied additional ptsd because residuals from her actions were not dianosed although I have been receiving psyc treatment for five years specific to her actions. I and the VARO in Wichita have the hearing transcripts. The VAMC in Wisconsin, in the hearing transcripts, admits to the wrong doings. My …

Copy, Highlight, And Send In Va Regs With Nod?
Just curious who has sent in VA regs to the VA with their NOD and how it played out. In another post (Ricky's Reconsideration thread), Berta made the following comment: I suggest you send as evidence a copy of the entire regs found in 38 CFR 3.317 and highlight with magic marker I (TS) have actually thought of doing that with my NOD since they didn't bother to read and apply their own regs but I didn't want to piss them off and instead only quoted the reg and gave the citation (38 CFR.....) but now I'm wondering if sending them a copy of their own regs highlighted with the applicable information may be a good plan and wonder how successful this course of action …
