Court Definition Of Possibly
I posted this on another site but would also like to see if any of my Hadit family has the answer. As I understand it the VA does not provide any weight to a medical opinion from a doctor unless it states at least as likely. A recent C/P mental health examiner provided in a recent C/P exam " anxiety possibly contributes to vet's IBS symptoms. Based upon this the VA denied service connection of the IBS (presumptive)due to service in GW1. The IBS symptoms appeared in 2003 and the anxiety was caused by a heart attack which happened in 2005. Differences In States Compensation
I recently read an article in the Columbus (Ohio) dispatch and they are saying that Ohio Veterans are the lowest compensated Vets of all. Illinios has moved up to about 6th place after Sen Barack Obama got very mad about a year ago and complained big time about the compensation disparity among states. In a nutshell, a Veteran is compensated an average of about $7000 per year in Ohio, while a New Mexico Veteran is compensated an average of about $4000 per year more. This is most likely to to the Cleveland Regional Office. Has any one else in Cleveland Regional Office been lowballed? These are averages.

Mental Health Disabilities Usually Compounded?
Is it usual for the VA to put two mental health issues into one compensation rating? Also, could a CUE work if I have an old VA claim response "denied for acquired pysch disorder" (not my words, theirs, way back when? I have data that supports coverage of that time period, a current diagnosis. thanks so much,cg

New Person With Questions
Hello all........... I'm having some difficulty with my VSO. Currently I am rated at 30 percent s.c. I just found out I have sleep apnea I retired 12/31/2003 but just finished second sleep study and issues CPAP. I had sinsus issues (they thought this was my fatigue cause so they did sinuses surgey septoplasty), daytime fatigue, car accident from falling asleep and all that while on active duty but some are missing from my medical record......any guidance on getting that s.c. Thyroid, I also just found out I have at least a nodule on it, I probably need to wait for a while on this but how about s.c. on this as well. Was there any connecton with the PGW for thes…

my co were i was stationed has sent me a statment proving i was in the company at the time of the stressor but he stated because it was so long ago he could not put me on the said detail that i witnessed i have spoken with the ncoic of the detail an sent pictures to him also but at this time he states he was there but can not remember me at this time my co has stated that the svc man was severily injured an was med. dischared from svc.

so I'm back in the game. my frustration level just about made me quit. but I digress... here is the question can i ask for a reconsideration, based on new evidence? originally filed 30mar06 denied twice filed nod 28nov06 obtained imo (bash) 05jan07 his opinion-- condition is due to service -- hand carried to ro got date stamped copies. been waiting for a denovo review don't think it's going to happen anytime soon If I withdraw my nod and ask for rsconsideration will it go any faster than waiting for a denovo review? Filing Claim After Initial Claim Denied At Dro Level
Hi, Hopefully, someone can answer my question. My husband filed a claim for low back trouble. He was denied due to lack of evidence in his SMRs and after service treatment lack of records all the way through a DRO review. He was diagnosed with degenerative disk disease by the VA. Ok, now for my question: Can he now file a "new" claim for this back trouble as a "secondary condition" to his service connected right knee. He was granted a hip secondary sc due to this knee condition. We feel that if we can just file a "new" claim (if it is still possible) that he stands a better chance at secondary (instead of direct) service connection. We were just not sure if you could …
